Title

Probation Department recommending the Board:

1) Make findings in accordance with El Dorado County Ordinance Code, Chapter 3.13.030 (B) that contracting out for electronic monitoring equipment and services with SCRAM of California is in the public's best interest and that there are specialty skills, qualifications, and equipment not expressly identified in County classifications involved in the performance of the work;

2) Approve and authorize the Chair to sign Amendment I to Agreement for Services 7784 with SCRAM of California for the Electronic Monitoring Program (home detention as a custody alternative), increasing the amount of the contract by $760,000, for a total compensation amount not to exceed $3,280,000, with no change in the term; and

3) Authorize the Chief Probation Officer and Deputy Chief Probation Officer to execute further documents relating to Agreement for Services 7784, including amendments which do not increase the total compensation amount or term of the Agreement, contingent upon approval by County Counsel and Risk Management.

 

FUNDING:  Public Safety Realignment (Assembly Bill 109) (65%); Pretrial (20%); Substance Abuse Focus Grant (10%); and Juvenile Probation Funding (5%).

DISCUSSION / BACKGROUND

The Probation Department (Probation) has been continuously operating the Electronic Monitoring Program (EMP) since 2006 to provide home detention services as a custody alternative for appropriate offenders.

 

There has been a significant increase in recent years in the Court's practice of releasing defendants from custody, thus increasing orders from the courts to use Global Positioning Satellite (GPS) and Continuous Alcohol Monitoring (CAM) tracking devices. This continued increase in court-ordered services necessitates an increase in the not-to-exceed amount of Agreement 7784 with SCRAM.

 

The term of Agreement 7784 is June 1, 2023, through May 31, 2025, with three one year renewal options. The current-year renewal option runs through May 31, 2027. Through Amendment I of Agreement 7784, Probation requests increasing the total compensation amount by $760,000 to fund services through the end of the current-year renewal. The proposed increase will increase the total compensation amount of the agreement from $2,520,000 to a new total not to exceed $3,280,000. Amendment I will also update the name of the Contract Administrator; Article XIX Conflict of Interest; and the California Levine Act Statement.

 

ALTERNATIVES

The Board could not approve the Amendment and provide direction to Probation to find alternatives for electronic monitoring services.

FINANCIAL IMPACT

There is no General Fund impact or increase to Net County Cost as a result of approving this item. Sufficient appropriations are included in Probation’s FY 2026-27 budget.

1) Obtain signature of Chair on two originals of Amendment I to Agreement 7784.

2) Forward one fully executed document to the Probation Department for finalization and distribution to the vendor.
