Department of Transportation recommending the Board :
1) Authorize the Department of Transportation to proceed with ordering title reports, certified appraisals, enter into negotiations with the owners, or their designated representatives, and commence with the acquisition process for the Pony Express Trail Bicycle and Pedestrian Improvements Project, CIP No. 97019, affecting the portions of the following subject parcels:
a) APNs 009-180-008 and -009, Evan and Lois Bell;
b) APNs 009-196-001 and -004, American Eagle Investments, LLC;
c) APN 009-350-065, DSS Mezz CA, LLC;
d) APN 009-350-062, Longs Drug Stores, Inc.; and
e) APN 009-350-017, El Dorado County Fire Protection; and
2) Appoint Tanna Reynoso, Associate Right-of-Way Agent (or designee) as the real estate negotiator on behalf of the County for said parcels.
FUNDING: Federal CMAQ Grants (28.7%) and State ATP Grants (71.3%).

DISCUSSION/BACKGROUND
Construction of the Pony Express Trail Bicycle and Pedestrian Improvements Project (Project) will consist of bicycle and pedestrian improvements to Pony Express Trail from Sanders Drive to Sly Park Road in the community of Pollock Pines. Specific improvements include approximately 1.7 miles of Class II bike lanes on both sides of Pony Express Trail; 4,600 linear feet of new and reconstructed asphalt pedestrian path on the south side of Pony Express Trail; Americans with Disabilities Act (ADA) improvements; crosswalks and signage with flashing beacons; and drainage improvements along Pony Express Trail within the project limits.
The County may need to purchase fee title or easements from the above listed parcels for the Project. In order for the Department of Transportation (Transportation) to research title records and prepare for negotiations with the subject parcel owners, Transportation is requesting authorization from the Board to proceed with the ordering and payment of title reports and certified appraisals for the land rights to be acquired.
Transportation is also requesting the Board authorize Transportation to enter into negotiations with the owners, or their designated representatives, of the parcels listed herein as related to the Project and appoint Tanna Reynoso, Associate Right-of-Way Agent (or designee) as the real estate negotiator on behalf of the County.
ALTERNATIVES
The Board could choose to not appoint a real estate negotiator and therefore not acquire the necessary parcels, which would not allow the Project to proceed.
PRIOR BOARD ACTION
On December 17, 2019 (Item 54), this project was included and adopted as part of the 2019 Capital Improvement Program (CIP) Book.

FINANCIAL IMPACT
This Project has no Net County Cost. The cost for title reports and color coded parcel maps is based on $600 per parcel. The total cost for the seven title reports required is $4,200. Funding for the Project is budgeted in FY 2020-21 as part of Transportation’s CIP and is funded by a combination of Federal Congestion Mitigation and Air Quality (CMAQ) Grants and State Active Transportation Plan (ATP) Grants.

This project will construct improvements that are vital to the County’s Infrastructure and Public Safety goals by facilitating pedestrians and bicyclists circulating within this corridor and providing safe roads for the traveling public within the area.
