Probation Department recommending the Board:
1) Make findings that the provision of drug and alcohol testing services provided by Contractor are in the public's best interest and that there are specialty skills, qualifications, and equipment not expressly identified in County classifications involved in the performance of the work in accordance with El Dorado County Ordinance Code, Chapter 3.13.030(b), El Dorado County Charter, Section 210(b)(6), and/or Government Code Section 31000;
2) Approve and authorize the Chair to sign Amendment I to Agreement for Services 6296 with Redwood Toxicology Laboratory, Inc., to increase the amount by $35,000 for a total of $175,000 with no change to the term to provide drug testing for the Probation Department; and
3) Authorize the Purchasing Agent, or designee, to execute further documents relating to Agreement for Services 6296, including amendments which do not increase the amount or term of the Agreement, and contingent upon approval by County Counsel and Risk Management.
FUNDING: General Fund (80%), Substance Abuse Focus Grant (10%), and Juvenile Justice Crime Prevention Act (10%) revenues.

DISCUSSION / BACKGROUND
Redwood Toxicology Laboratory, Inc. (Redwood) has been providing drug and alcohol testing services to the Probation Department (Probation) since 2006.
On May 17, 2022, with Legistar file 22-0210, the Board approved Agreement 6296 with Redwood to provide drug and alcohol testing on an "as requested" basis for a term of May 17, 2022 through May 16, 2025 for an amount not to exceed $140,000. This agreement was approved by the Board prior to the current Purchasing Policy going into effect so there was no competitive bid required for the services.
This Amendment I to Agreement will increase the amount by $35,000 for a total of $175,000. Probation requests the increase in funding of the Agreement due to increased usage since inception of the Agreement for Probation clients, as well as clients referred by the Courts. The Courts have no means to provide drug testing services.
ALTERNATIVES
If the Board denies approval of Amendment I to Agreement 6296, Probation will have to find another provider for drug testing services as soon as possible. Securing another vendor would take months, and ongoing drug testing services are necessary for many of Probation’s clients and clients referred by the Courts.

FINANCIAL IMPACT
There is no increase to Net County Cost. Funding is included in Probation’s FY 2024-25 budget and will be included in subsequent years’ budget requests.
