DISCUSSION / BACKGROUND

A request has been submitted by Brian D. Spears, an unmarried man and Jodi K Votava, an unmarried woman, owners of Assessor's Parcel Number 116-740-011, requesting that the County of El Dorado, Board of Supervisors, vacate the rear and side Public Utility easements located on said property. The easements are more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution.

 

The Public Utility easements, as shown on Lot 11 of Bass Lake Village Unit No. 7, recorded in Book I of Subdivisions at Page 34, were offered to the County of El Dorado by Bass Lake, LLC, a Delaware Limited Liability Company By: Steve Thinglum, on April 15, 1999. The easements were accepted by the County of El Dorado on April 27, 1999, and the Subdivision Map was recorded on May 4, 1999.

 

AT&T, Comcast, El Dorado Irrigation District and Pacific Gas & Electric have not used said subject easements for the purposes for which they were dedicated and find no present or future need exists for said subject easements and do not object to their vacation, and to that end, have all issued letters to that effect.

FINANCIAL IMPACT

The Surveyor’s Office collects a fee for processing the Abandonment of Easement on a time and materials basis.  There is no fiscal impact as a result of the approval of this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the one (1) Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution for further processing to the Surveyor's Office, Attn: Carter Meyers.
