DISCUSSION / BACKGROUND
This informational workshop for the Board of Supervisors is being hosted by the Planning and Building Department, Planning Division, Long Range Planning (LRP) Unit. The purpose of this workshop is to solicit comments from the public and the Board on the revised draft amendments to Title 130 of the County Code - Zoning Ordinance, Section 130.40.130 - Communications Facilities. No formal action will be taken.
On February 22, 2024, Legistar File 24-0265, staff held a public workshop with the Planning Commission to solicit feedback on several targeted amendments to the Zoning Ordinance, including amendments to Chapter 130.36 (Signs), Chapter 139.39 (Oak Resources Conservation) and Section 130.40.130 (Communications Facilities).
To expedite the Zoning Ordinance amendments, the Board directed staff to move each of the above components forward for adoption separately, with Section 130.40.130 (Communications Facilities) to be adopted first as specified on the Board’s Long Range Planning Work Plan for Fiscal Year (FY) 2024-25 (Legistar File 24-1332). The draft amendments to Title 130, Section 130.40.130, including recommended revisions based on public and Planning Commission comments from the February workshop, are included as Attachment A. For ease of use, a summary of the recommended revisions is included as Attachment B.
Staff plans to return to the Planning Commission in October 2024 and the Board in December 2024 for final adoption hearings (First Reading). Staff will provide a final draft of the Section 130.40.130 (Communication Facilities), along with any implementing ordinances, all of which will reflect comments from today’s workshop and written public comments received.

PRIOR BOARD ACTION
On March 17, 2020, Legistar File 20-0326, the Board approved and endorsed the Planning and Building Department, LRP, Project Prioritization Matrix for FY 2020-21, which included updating various sections of the Zoning Ordinance. One of the sections included in this effort is to update Section 130.40.130 (Communication Facilities). This Zoning Ordinance Update effort has been included on the following subsequent LRP Work Plans: 4/13/2021, File No. 21-0502; 6/28/2022, File No. 22-1101; 6/13/23, File No. 23-1059, and File No. 24-1332.
On July 31, 2021, Legistar File 21-1042, the Board approved the Resolution of Intention (ROI) 082-2021, to initiate an Amendment to Title 130 of the County Zoning Ordinance to revise applicable sections in Article 3; Section 130.40.130 - Communications Facilities.
On December 7, 2021, Legistar File 21-1753, the Board approved Agreement 5857 with Dudek to assist the County in updating Title 130 of the County Zoning Ordinance, with a not-to-exceed amount of $102,545, and a term of three (3) years.

FINANCIAL IMPACT
There is no change to Net County Cost associated with this item. Funding for the Zoning Ordinance Update project has been included in the Fiscal Year 2024-25 budget. Funding for services beyond FY 2024-25 will be included in subsequent budgets accordingly.
