Fiscal Impact/Change to Net County Cost:
There is no fiscal impact and no change to Net County Cost associated with this item.
 
Background:
In late 2007, the County's Procurement and Contracts Office released a Request for Qualifications (RFQ) for the Department of Transportation (DOT) for a variety of transportation related disciplines. Based on the results of that RFQ, Dowling Associates was the #1 firm in the specialty categories of Traffic Operations Functions and Planning Studies and Reports.
 
The Board approved Agreement #08-1661 with Dowling Associates, Inc. on June 3, 2008 to provide on-call Traffic Engineering and Transportation Planning Services for a two-year term.   Subsequently, as allowed under the Terms of the Agreement, an increase to Dowling Associate's Fee Schedule of four percent  (4%) was granted effective January 1, 2009.
 
Reason for Recommendation:
DOT is requesting approval to extend the current Agreement for a period of one year so that work already assigned under an outstanding Task Order may be completed and so that additional Task Orders may be issued during the extended term of the Agreement.
 
Additionally, this Amendment modifies three other Articles in the original Agreement.  Article XV Notice to Parties and Article XXV Contract Administrator are updated to reflect staffing changes within DOT.  Exhibit B, referenced in Article III Compensation for Services is replaced with Amended Exhibit B, reflecting the same Labor Rates as were approved on January 1, 2009.  Due to the current economic environment, no increase was requested nor granted for 2010.
 
There is no increase in the not-to-exceed dollar amount of the contract.
 
The Procurement & Contracts (P&C) Division of the CAO's office has reviewed DOT's request to process an Amendment to this Agreement and concurs that a competitive selection process, including evaluation by an outside reviewer, has occurred and has not expired. The P&C Division of the CAO's office concurs that DOT's request is in compliance with Board of Supervisor's Policy C-17, Sections 7.4.2, 7.5 and 7.10.
 
The El Dorado County Employee's Association, Local #1, was informed of this proposed Contract Amendment on January 28, 2010.
 
Action to be taken following Board approval:
1) The Board Clerk will have the Chair sign two (2) originals of Amendment I to Agreement #08-1661 with Dowling Associates, Inc., and will forward one (1) fully-executed original Amendment to the Department of Transportation for further processing.
