1) Approve the Final Passage (Second Reading) of Ordinance 5224, Planning and Building Department Fee Schedule; and

2) Adopt and authorize the Chair to sign Resolution 020-2025, establishing a resolution for the Cemetery Division Fee Schedule.(Cont. 2/11/2025, Item 11)

DISCUSSION / BACKGROUND

On February 11, 2025 (Item 21) the Board heard the Introduction (First Reading) of Ordinance 5224 and Continued the matter to February 25, 2025 for Final Passage (Second Reading). The Board also continued Resolution 020-2025 to February 25, 2025.

 

The Planning and Building Department (Department) engaged in a comprehensive fee update performed by NBS Government Finance Group, Inc. (“NBS”). The study started in May of 2021. After two (2) years the Department returned to the Board on August 15, 2023, (Legistar file 23-1487) with the comprehensive study and conceptual approval.  On October 24, 2023, (Legistar file 23-1672), the Board approved Ordinance 5185, Planning and Building Department Fee Schedule. 

 

On January 23, 2024, (Legistar file 23-2157), the Board approved the reassignment of the Airports and Cemeteries Division from the Planning and Building Department (Department) to the Chief Administrative Office, to be effective July 1, 2024.

 

On December 10, 2024, (Legistar file. 24-1891), the Board approved the final passage (Second Reading) of Planning and Building Fee Ordinance 5213 which amended Ordinance 5185 to remove Airports', a division of the Chief Administrative Office, fees from the Planning and Building Fee schedule.  

 

Since the adoption of Ordinance 5185 in 2023, the Department has identified the need for minor adjustments to select division fees and has determined that additional fees are necessary.  The proposed modifications will correct unintended omissions, more clearly define and organize some fees, and add and amend fees related to the recently updated Vacation Home Rental Ordinance (Ordinance 5209) adopted by the Board on October 22, 2024 (Legistar file 24-1555).  These modifications will ensure the department continues to meet cost recovery goals.

 

On January 28, 2025 (Legistar file 25-0134), the Board approved staff to amend Ordinance 5213 entitled “Planning and Building Department Fee Schedule" to make minor modifications to fees and to remove Cemetery Division Fees (Exhibit C) per Board policy A-3 - Ordinances - New or Amended, resulting from the move of the Cemeteries Division to the Chief Administrative Office, therefore, the Cemetery fees will be placed in their own Resolution with no proposed changes at this time. ALTERNATIVES

The Board may choose not to adopt the proposed recommend fee changes and modifications for the amended ordinance and provide further direction.

October 24, 2023 (Legistar file. 23-1672), Board adopted Ordinance 5185, Planning and Building Fee Schedule, adopted and approved the Planning and Building Department, Policies and Procedures.

 

January 23, 2024, (Legistar file 23-2157), Board approved the reassignment of the Airport and Cemetery programs to the Chief Administrative Office, effective July 1, 2024.

 

October 22, 2024 (Legistar file 24-1555), the Board approved the final passage (Second Reading) of Ordinance 5209 amending Title 5 - County Business Taxes, Licenses and Regulations of the El Dorado County Ordinance Code, amending Chapter 5.56 - Vacation Home Rentals, to add the recommendations of the Vacation Home Rental Advisory Committee and Board of Supervisors.

 

December 10, 2024, (Legistar file 24-1891), the Board approved the final passage (Second Reading) of the amended Ordinance 5185, removing the Airports Division Fees (Exhibit B), creating the Planning and Building Fee Ordinance 5213.

 

On January 28, 2025 (Legistar file 25-0134), the Board approved staff to amend Ordinance 5213 entitled “Planning and Building Department Fee Schedule" to make minor modifications to fees and to remove Cemetery Division Fees per Board policy A-3 - Ordinances - New or Amended.

FINANCIAL IMPACT

There will not be a major financial impact associated with the Ordinance update. Changes to the fees may result in a small increased revenue to support the Planning and Building Department from the few new fees added.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Continue this matter to the Board of Supervisors regular meeting scheduled on February 2025, 2025, for Final Passage (Second Reading).

2) Publish the ordinance Summary in the local newspaper no less than five (5) days prior to Final Passage.

3) Publish the ordinance within fifteen (15) days after its passage in a newspaper of general circulation published and circulated in the County following Final Passage.

4) Obtain the Chair's signature on Resolution 020-2025 and forward one copy to the Chief Administrative Office, Attention: Laura Schwartz.
