Department of Transportation recommending the Board:
1) Authorize the Department of Transportation to proceed with ordering title reports and certified appraisals, enter into negotiations with the owners, or their designated representatives, and commence with the acquisition process for the Clear Creek Road Scour Mitigation Project, Capital Improvement Program No. 36106002, affecting the portions of the following subject parcels:
a) APN 079-110-046, Nick Caputo and Jennifer Caputo, husband and wife, as joint tenants with rights of survivorship; and
b) APN 079-110-024, Jason Kline and Celeste Kline, husband and wife, as joint tenants; and
2) Appoint Monument ROW as the real estate negotiator on behalf of the County for said parcels. (Supervisorial District 3)

DISCUSSION/BACKGROUND
In August 2021, the Department of Transportation (Transportation), Maintenance and Operations Division (Maintenance) identified a deficiency on Clear Creek Road approximately 1.3 miles north of the intersection of Sly Park Road and Clear Creek Road. A large ponderosa pine tree fell across Clear Creek and landed on Clear Creek Road, causing damage to the road that reduced the already minimal road width by up to one foot. Given that Clear Creek Road is an important alternate evacuation route for the Sierra Springs and Starkes Grade corridors, Transportation Maintenance and Engineering staff have determined that the roadway width in this area must be increased.
The County may need to purchase easements from the above listed parcels for the Clear Creek Road Scour Mitigation Project (Project). In order for Transportation to research title records and prepare for negotiations with the subject parcel owners, Transportation is requesting authorization from the Board to proceed with the ordering and payment of title reports and certified appraisals for the land rights to be acquired.
Transportation is also requesting the Board authorize Transportation to enter into negotiations with the owners, or their designated representatives, of the parcels listed herein as related to the Project and appoint Monument ROW as the real estate negotiator on behalf of the County.
ALTERNATIVES
The Board could choose not to appoint a real estate negotiator and therefore not acquire the necessary parcels, which would not allow the Project to proceed.
PRIOR BOARD ACTION
The Project is included in Transportation’s 2022 Capital Improvement Program (CIP), which was approved by the Board on June 14, 2022, Item 48, Legistar 22-0521.

FINANCIAL IMPACT
This Project has no net County cost. The cost for title reports and color coded parcel maps is based on $850 per parcel. The total cost for the two title reports required is $1,700. Funding for the Project is budgeted in Transportation’s 2022 CIP and is funded by Coronavirus Response and Relief Supplemental Appropriations Act of 2021.
