Background:
Reason for Recommendation:
Public utility easements, as shown on Hollow Oak Unit No. 4 final map recorded in Book J of Subdivision Maps at Page 70, were irrevocably offered in perpetuity to the County of El Dorado in June of 2005, and accepted by the Board of Supervisors in April of 2006.
An application has been submitted by Pulte Home Corporation, a Michigan corporation, owner of Lots 64, 75 and 76, requesting that the County of El Dorado Board of Supervisors vacate a portion of the public utility easements that are found to be encumbrances that unnecessarily restrict development of the subject lots, located in the front areas adjacent to Copper Lantern Court and Cradle Mountain Court, of Lots 64, 75 & 76, identified as Assessor's Parcel Numbers 119-370-02, 119-370-13 and 119-370-14. Said easements are more particularly described in Exhibits "A-1", "A-2" and "A-3" and depicted in Exhibits "B-1", "B-2" and "B-3" of the attached Resolution.
The subject properties are located on Copper Lantern Court and Cradle Mountain Court, east of Bass Lake Road and north of US Highway 50, in western Cameron Park. Said action is necessary to accommodate construction of improvements on the subject lots.
All utility companies that could be impacted by this vacation have provided the Department of Transportation with written notification that they have no facilities within the subject areas and have no objection to the proposed abandonment. All other existing easements will remain. The Department of Transportation's staff has reviewed the request and has no objection.
Action to be taken following Board approval:
1) Said Resolution will be recorded.
2) A copy of the recorded Resolution will be sent to the property owners.
3) A Certificate of Correction may be recorded.
