Health and Human Services Agency recommending the Board approve and ratify the Chief Administrative Officer’s signature on Amendment 1 to Agreement for Services 5078 with Avellino Lab USA, and on Amendment 1 to Agreement for Services 5075 with WestPac Labs, Inc., for COVID-19 testing and lab results, thereby extending the expiration date of each agreement to June 30, 2021 and continuing thereafter on a month-to-month basis until terminated, or until thirty (30) days after termination/expiration of the Governor’s Shelter-in-Place Order (N-33-20), whichever occurs first.
FUNDING: Federal and State: Possible CARES Act, and/or Federal Emergency Management Agency; with potential use of Realignment based on FEMA reimbursement.

DISCUSSION / BACKGROUND:
The Governor of the State of California declared a State of Emergency on March 4, 2020. The World Health Organization declared COVID-19 a pandemic on March 11, 2020 and on March 19, 2020, the Governor of the State of California executed Executive Order N-33-20.
Screening, case investigation and contact tracing are proven methods to slow the transmission of communicable diseases such as COVID-19, therefore, the Health and Human Services Agency (HHSA) determined that it is necessary to increase testing within the County and executed Agreement #5078 with Avellino Lab USA, Inc. and Agreement #5075 with WestPac Labs, Inc. These agreements have provided HHSA with the COVID-19 testing supplies and laboratory results for both the HHSA Public Health Division activities, as well as El Dorado County Office of Education testing activities.
On December 28, 2020, the Chief Administrative Officer executed Amendment 1 to Agreement #5078 with Avellino Lab USA, Inc. and Amendment 1 to Agreement #5075 with WestPac Labs, Inc. thereby extending the expiration date of each agreement from December 30, 2020 to June 30, 2021 and continuing thereafter on a month-to-month basis until terminated, or until thirty (30) days after termination or expiration of the Governor’s Shelter-in-Place Order (N-33-20), whichever occurs first.
The prior Board items (20-1060 & 20-1061) authorized the Purchasing Agent, or designee, to execute further documents relating to Agreement, including amendments which do not increase the maximum dollar amount or term of the Agreement, and contingent upon approval by County Counsel and Risk Management.
In accordance with Resolution 138-2020, these time sensitive amendments were signed by the Chief Administrative Officer (CAO), and are now being presented to the Board for ratification of the CAO signature on each Amendment. Resolution 138-2020 delegates authority to the CAO to execute agreements and amendments specific to COVID-19 testing, health support and services in the County with direction to bring any contracts or amendments that exceed purchasing agent authority to the Board for ratification within 30 days.

No viable alternative recommendations are available to continue access to laboratory testing and results for COVID-19.

FINANCIAL IMPACT:
There is no Net County Cost associated with this Board item. Appropriations are included in the FY 2020-21 Adopted Budget for COVID-19 testing and will be included in future budgets as necessary. It is not expected that projections will exceed appropriations at this time, however if projections increase significantly HHSA will return to the Board with a budget amendment to add appropriations.
