DISCUSSION / BACKGROUND

On August 18, 2026, the Board of Supervisors (Board) approved the negotiated Memorandum of Understanding (MOU) between the County of El Dorado and Operating Engineers Local No. 3, representing the Corrections Bargaining Unit.  The MOU indicated that effective the first full pay period following Board adoption of the July 1, 2026, to June 30, 2028, MOU, or the first full pay period in July 2026, whichever occurred later, the County would increase total compensation for benchmark classifications and internally tied non-benchmark classifications to approximately (+/- 8%) of the total compensation median of the County’s February 2026 comparable agency compensation survey. To achieve this, the County increased base wages by 11.26%. These salaries were effective the pay period beginning August 22, 2026.

Due to calculation errors for salary step 5 of job classification 5510 (Sheriff’s Correctional Sergeant) and salary steps 2 and 4 of job classification 5501 (Sheriff’s Correctional Officer I), seventeen employees in the Corrections Unit were erroneously overpaid between $0.06 and $0.33, for a total of $3.63. Given that the administrative cost required to process the repayment of $3.63 far exceeds the amount owed, it is requested that this repayment be waived.

Additionally, one employee in the Corrections job classification 5502 (Sheriff’s Correctional Officer II) was overpaid $75.20. This employee passed away since this error was identified, and Human Resources is requesting this overpayment be waived as well.

Human Resources is requesting the Board waive recovery of overpayment made to these eighteen employees, as payment at the time had been made in accordance with an errant salary schedule previously in effect. If directed to recover the overpayment, it is likely that the staff time incurred to attempt to recover the overpayment would exceed the amount of overpayment.

ALTERNATIVES

The Board could choose not to approve the waiver of recovery of overpayment of approximately $78.83 and authorize and direct the Payroll Division of the Auditor/Controller's Office to seek repayment from the employee(s) in the affected classifications.
