Fiscal Impact/Change to Net County Cost: Amendments with Progress House, Inc. will increase total compensation for its respective agreements by $14,022.  Of that, $3,256 is funded by salary and benefit cost savings, provided for by an interdepartmental MOU related to the CalWorks program; $10,766 is funded by salary and benefit cost savings, provided for by a federal grant related to the State's Comprehensive Drug Court Implementation (CDCI) program.  The amendment with Sierra Recovery Center increases the total compensation by $1,224 and is funded by a Substance Abuse Prevention and Treatment (SAPT) federal block grant related to the State's Substance and Crime Prevention Act (Prop 36) program.  There is no net County cost.
 
Background:   Drug treatment and testing services were ordered by mandate from the County's Drug Court and/or authorized by the Department.  Under contract, the Department is required to compensate providers for these services per the requirements of the associated funding agreements, signed by the County, and to the interdepartmental MOU between Human Services and Public Health.  The cost of total services provided in FY 2005-06 exceeded contract amounts.  
 
Reason for Recommendation:  Services provided for drug treatment, testing, etc., and the costs associated, are difficult to forecast when contracts are initially executed.  In these instances, services were provided near the term end for these contracts, all of which expired June 30, 2006.  The Department moved to amend these contracts and compensate the providers fully.  However, several factors slowed the amendment process.  
 
These amendments are retroactive as to term due to the time needed for the Department to recalculate the total amount of compensation needed from each funding source (federal and state) and for the State to approve those totals.  These figures were presented to the State in the County's FY 05/06 Cost Report, which was finalized by the County, approved by the Auditor, and received by the State in October.  Due to a number of similar retroactive amendments related to the County's alcohol and drug treatment (ADP) programs, staff decided to send all ADP amendments to the Board at once to allow for a full and comprehensive discussion about the issues surrounding them.
 
Action to be taken following Board approval: Chair to sign three (3) copies of each amendment; Board Clerk's Office to return two (2) copies of each signed amendment to Department, Department to distribute as appropriate.
