The estimated cost of the election is $450.00. All costs associated with the election will be funded from the Maverick Road Zone of Benefit assessments or special tax.
 
There are currently 24 parcels in the Maverick Road Zone of Benefit. A total of 22 parcels are assessed $250.00 annually, with one parcel charged $62.50 annually, and another parcel that is not assessed,  which generates annual revenue of $5,562.50 to fund road maintenance and improvement services within the zone. If approved, the special tax will replace the current benefit assessments, allow for an annual inflator, and will continue to fund road maintenance and improvement services within the zone.  The amount of the special tax will be $450.00 levied on each parcel, providing  $10,800.00 in revenue, an increase of $ 5,237.50 over the amount currently received. Application of the inflation index will allow for annual increase of the special tax to keep pace with increases in construction costs.
 
There is no net county cost associated with the election.
 
Reason for Recommendation:
 
Your Board formed the Maverick Road Zone of Benefit #98188 on June 6, 1995 by Resolution 146-95 for the purpose of providing road maintenance and improvement services. Since formation, the zone operations have been funded through annual benefit assessments upon each parcel of land within the zone boundaries.  The zone advisory committee recently notified Department of Transportation staff of their desire to establish a special tax to replace the benefit assesssment. If approved, the special tax will increase zone revenues in order to keep pace with increasing labor and material costs. The zone advisory committee prefers the special tax over a benefit assessment increase because there are fewer administrative requirements once it has been established, and it is therefore less costly to the zone.
 
California state law requires approval by registered voters within the zone to establish a special tax. The  Registrar of Voters must conduct an election to allow the voters to consider the special tax. The Department of Transportation requests your Board set the measure shown on Exhibit A for a mailed ballot election. Should the measure pass, the special tax will replace the benefit assessments. Should the measure fail, the advisory committee wishes the Board to continue the existing benefit assessment at the current level.
 
Action to be taken following Board approval:
 
1. Certified copies of the Resolution will be sent to the Department of Transportation and the County Registrar of Voters.
 
2. The Registrar of Voters will conduct a mailed ballot election on May 8, 2007 to consider the establishment of a special tax for the purpose of providing road maintenance and improvement services within the Maverick Road Zone of Benefit #98188 within County Service Area #9.
