Fiscal Impact/Change to Net County Cost
There is no Net County Cost associated with this Agreement.  Sufficient appropriations were included in the Fiscal Year 2012-13 budget in anticipation of this Amendment.
Contract Terms
Payments were made to Contractor based upon monthly invoicing for actual services performed and documented per contract requirements.  The Agreement contains both the standard Fiscal Considerations clause and the standard termination without cause provision allowing the County to terminate upon seven (7) days written notice.
Background
The Health and Human Services Agency, Public Health Division (HHSA/PHD) received funding through Sacramento County (acting as fiscal intermediary for Federal Ryan White funding) for the term March 1, 2007 through June 30, 2012, and passed those funds through to sub recipient Sierra Foothills AIDS Foundation to provide services defined in the funding Agreement. Sacramento County amended the Agreement with HHSA/PHD six times, adjusting the maximum amount of funding based on availability of Federal funds.
During the term July 1, 2009 through March 31, 2010, SFAF became aware that Sacramento County intended to increase funding and provided services in excess of the not-to-exceed amount (NTE) of their Agreement with HHSA/PHD.  To retroactively amend the Agreement and increase the NTE, HHSA/PHD needed documentation of the increase in services.  The data became available in an August 2012 report from Sacramento County showing increased service units.  HHSA/PHD developed this Amendment I incorporating additional funding to reimburse vendor for the additional services.  
 
Reason for Recommendation
Approval of this Amendment I to Agreement 187-S1011, increasing the not-to-exceed amount by $4,190 to $101,402, with no change to term, will allow HHSA/PHD to reimburse Contractor for services previously provided.
Action(s) to be taken following Board approval
1. Chair to sign two (2) original Amendments I to Agreement 187-S1011.
2. Clerk of the Board's Office to return one (1) original Amendment I to Agreement 187-S1011 to HHSA/PHD at 3057 Briw Road, Suite A.
3. HHSA/PHD to distribute documents as appropriate.
