DISCUSSION / BACKGROUND

On June 26, 2025, El Dorado County Planning and Building Department received a courtesy copy of a Petition for Condition Modification (Petition) from the Department of Alcoholic Beverage Control (ABC). The Petition was sent to ABC on May 28, 2025 from a consultant representing the Shingle Springs Gaming Authority requesting the removal of current License Condition #2 imposed on License No. 20-656155 for the Express Fuel Travel Center located in Shingle Springs.

 

Condition #2 on License No. 20-656155 states, “There shall be no amusement machines or video game devices in or on the premises at any time.” The Petition is requesting the removal of this condition to allow for a single “claw machine” arcade game to be placed at the Express Fuel Travel Center. State statute is not clear on the definition of amusement machines or video game devices. The County is supportive of the removal of the condition as long as it does not allow any gaming or slot machines to be placed at the travel center.

 

Business and Professions Code Section 23803 allows the local governing body 30 days to object to the modifications or removal of conditions on licenses through ABC. Although the County does not object to the addition of a “claw machine” at the travel center, Supervisor Parlin would like to submit a letter supporting the removal of condition while expressing opposition to any gaming or slot machines at the location.

 

ALTERNATIVES

The Board could choose not to send the letter or make modifications to the letter.
