Fiscal Impact/Change to Net County Cost:
 
The estimated cost of the election is $500.00. All costs associated with the election will be funded from the Dolly Varden Lane Zone of Benefit assessments or special tax.
 
A total of 21 parcels within the zone are currently assessable. However, in 1992 the Adviosry Committee recommended a $0.00 assessment until such time as the fund balance for the zone was depleted to $2,000.00.  Zone operations have been funded through the balance carried forward from year to year. Changes in County code and state law that have since occurred require a protest ballot proceeding or an election in order to re-instate the benefit assessment or to establish a special tax.
 
The zone advisory committee recently advised Department of Transporation staff of their desire to once again assess the parcels within the zone in order to fund future projects and continue zone operations. If the proposed measure is approved, the current $0.00 benefit assessment will be replaced with a special tax of $200.00 per parcel for fiscal year 2007/2008, which will be adjusted to $100.00 per parcel for fiscal year 2008/2009 and each year thereafter. The special tax, if approved, will result in annual revenue of $4,200.00 in 2007/2008, and annual revenue each year thereafter of $2,100.00.
 
Reason for Recommendation:
 
Your Board formed the Dolly Varden Lane Zone of Benefit #98126 on November 19, 1985 by Resolution 354-85 for the purpose of providing road improvement and maintenance services. Since formation, zone operations have been funded through annual benefit assessments or the fund balance carried from year to year.
 
The zone advisory committee recently notified Department of Transportaion staff of their desire to establish a special tax to replace the current benefit assessment. If approved, the special tax will provide a sources of revenue to fund road improvements and maintenance within the zone. The zone advisory committee prefers a special tax over a benefit assessment increase because there are fewer administrative requirements once it has been established, and therefore it is less costly to the zone.
 
California state law requires approval by registered voters within the zone to establish a special tax. The Registrar of Voters must conduct an election to allow the voters to consider the speical tax. The Deparment of Transportation requests your Board set the measure shown on Exhibit A for a mailed ballot election. Should the measure pass, the special tax will replace the benefit assessment. Should the measure fail to acheive the required two-thirds majority approval, the advisory committee will explore alternatives for funding zone operations. The residents and advisory committee members do not wish to dissolve the zone of benefit.
 
Action to be taken following Board approval:
 
1. Certified copies of the Resolution will be sent to the Department of Transportation and the County Registrar of Voters.
 
2. The Registrar of Voters will conduct a mailed ballot election on May 8, 2007 to consider the establishment of a special tax for the purpose of providing road improvement and maintenance services within the Dolly Varden Lane Zone of Benefit #98126 within County Service Area #9.
