Department of Transportation recommending the Board approve the following:
1) Find JSF Technologies beacons and parts are exempt from competitive bidding in accordance with County Procurement Policy C-17 Section 3.4.2 due to Traffic Signal Solutions being a sole source supplier;
2) Authorize the Purchasing Agent to increase purchase contract 10146 for the purchase of beacons and parts, in the amount of $100,000 for a new total of $199,000, for the remainder of the three (3) year term ending on February 28, 2029; and
3) Authorize the Purchasing Agent to increase the purchase contract on an "as needed" basis during the awarded period as long as funding is available within the requesting department's budget.
FUNDING: Road Fund (100%).

DISCUSSION / BACKGROUND
Department of Transportation (Transportation) has historically purchased and utilized JSF Technologies beacon parts at various locations countywide. Previously, each time a purchase was requested, a sole source request was generated and approved. Due to the volume of anticipated replacement beacon and repair part purchases over a three (3) year period, Transportation determined a three (3) year purchase contract was necessary. Annually, Transportation purchases beacon systems or replacement parts; however, during the most recent budget process the beacon replacement parts budget was increased leading to the request to increase the existing purchase contract.
County Procurement Policy C-17 3.4.2 describes sole source/single source purchases where there is only one vendor capable of providing an item or service, and therefore it is not possible to obtain competitive bids because of (d) a distributor has an exclusive franchise or operating agreement with the supplier of goods to be purchased or maintained and no other person or entity may provide, install, service, or maintain the goods in the County’s jurisdiction. Due to this exemption, Transportation is able to purchase solely from Traffic Signal Solutions for JSF Technologies beacons and parts.

FINANCIAL IMPACT
