Fiscal Impact/Change to Net County Cost: Attached are two separate Budget Transfer Requests.  One was prepared and signed by Public Health and requests $100,000 be transfered from Fund 20 to Fund 11.  Of that amount, $65,045 will be provided to Probation for additional Prop 36 services, and is reflected on the second attached Budget Transfer, which was prepared and signed by Probation.  The remainder will be used by Public Health for additional treatment by third-party providers and for Drug Court related training activities.  Special revenue Prop 36 Drug Crime Prevention funding will be used to cover increased appropriations.   There is no Net County cost.

Reason for Recommendation: Due to an increase in the need for services and training, and to the availability of unspent funds, Public Health and Probation require added appropriations.  Specifically, Public Health will pass $65,045 to Probation  to support a portion of a third Prop 36 Probation Officer in the current fiscal year.  Three Officers are currently assigned to the Program due to caseload size.  However, Public Health typically provides Probation with funds to cover two of those officers.  FY 2006-07 was an exception, as Prop 36 funds were held in anticipation of being used toward the development of a portion of the State's mandated Cal OMS reporting system.  Because Public Health was able to use in-house staff to complete that project, additional funding was available for Probation.  Public Health does not plan to fund above two Probation Officers for Prop 36 in FY 2007-08.

The remaining $35,000 will be retained by Public Health and utilized as follows: $10,000 to support staff training, development and attendance at the National Drug Court Conference; and $25,000 to contracted service providers who may exhaust original FY 2006-07 funds.

Action to be taken following Board approval: Chair to sign attached MOU and Budget Transfers, Board Clerk's Office to forward Budget Transfer documents to Auditor's office for posting and two (2) copies of MOU to Public Health for distribution as appropriate.
