Health and Human Services Agency recommending the Board approve the corrected amount listed for Agreement 279 with the California Mental Health Services Authority for membership in a Joint Exercise of Powers Authority, for management of various state-wide behavioral health programs, as shown on line 6 in the list of perpetual agreements as detailed in Attachment C.

DISCUSSION / BACKGROUND:
Board of Supervisors Policy C-17, Section 4.5, “Contract Term,” requires departments to obtain authorization from the Board of Supervisors, initially, and on an annual basis, to use any contract that does not have a stated agreement term.
Since the implementation of FENIX, each perpetual agreement must have a change order executed to allocate funding for payment(s) in the upcoming fiscal year. The Health and Human Services Agency (HHSA) obtained the Board’s approval of its current list of perpetual agreements on May 19, 2020 (File ID 20-0450). However, the amount(s) must be estimated for those agreements that have updated amounts annually. Following approval of the list of perpetual agreements (Attachment A) on May 29, 2020, HHSA received information from the California Mental Health Services Authority (CalMHSA) that the amount for Fiscal Year (FY) 2020-21 for Agreement 279 was higher than the estimate on the original list.
HHSA recently obtained CalMHSA’s FY 2020-2021 Member Annual Program Funding Commitment (Form) (Attachment B). For ease of reference, HHSA has listed the associated Agreement number next to each applicable line item on the Form. In addition, the perpetual agreement list has been updated (Attachment C) to be in compliance with the Funding Commitment Form and the updated amount of $68,753 for Agreement 279 now includes the annual membership fee ($500), Prevention and Early Interventions (PEI) FY 20-21 participation ($58,252.80), and an additional $10,000 to cover new programs that may be developed by CalMHSA during FY 2020-2021. HHSA will make every effort to obtain the Form prior to taking future annual perpetual agreement lists to the Board so that the most accurate amount is reflected in the list.
California Government Code Sections 6500 through 6536 permit two or more public agencies by agreement to jointly exercise powers common to the contracted parties. In collaboration with the California Mental Health Directors Association (CMHDA), a Joint Exercise of Powers Authority (JPA) was developed to administer the statewide training, technical assistance, and capacity building of the Proposition 63 Mental Health Services Act (MHSA) Prevention and Early Intervention (PEl) programs, as well as other programs as needed. The California Mental Health Services Authority (CalMHSA) was created in 2009 to allow member counties the opportunity to collaborate with all other members for the administration of the statewide projects. Each member county has representation on the Authority's Board of Directors and the ability to attend, participate in, and vote on actions of the Board of Directors.
Agreement 279 with CalMHSA allows CalMHSA to provide additional services including joint contracting for State hospital beds, joint administration of other State or Federal programs, provision of fiscal, administrative services, research, development and other requests from the County Mental Health Directors Association and/or the California State Association of Counties. These changes do not impose any additional obligation on the County and the County is not obligated to participate in any added programs or services. Each county determines whether it will participate in a program and, with Board approval, will pay only its share of those programs in which it chooses to participate. Members have no financial obligation for programs in which they do not participate.
After a change order for Agreement 279 is released, HHSA is recommending the Board authorize the Purchasing Agent to post it to ensure that the various participation costs under Agreement 279 can be paid in FY 2020-2021.
ALTERNATIVES:
If the Board does not approved this recommendation, HHSA will be unable to process payment(s) for the participation fees associated with Agreement 279.

FINANCIAL IMPACT:
There is no Net County Cost associated with this Agenda Item. The value of each perpetual agreement for FY 2020-21 is identified in Attachment C. Sufficient appropriations were included in the FY 2020-21 Budget and will be included in future budgets for the term of the perpetual agreements.
