Fiscal Impact/Change to Net County Cost: Funding for the engines to be installed in four units of Department Transportation equipment is included in the fiscal year 2009/2010 Road Fund budget. There is no change to Net County Cost.
Background: The California Air Resources Board (CARB) Airborne Toxic Control Measure, effective September 12, 2007, was enacted to reduce diesel particulate matter emissions from portable engines having a rated brake horsepower of 50 and greater. A portable engine is one that is capable of being carried or moved from one location to another. This category of engines includes back-up or stand-by engines and engines that power auxiliary functions in equipment. The measure requires portable diesel-fueled engines to be registered and certified for compliance with the CARB emissions standards or replaced by March 31, 2010. The Department of Transportation has two durapatch machines, a brush chipper and a paint striper with portable engines all manufactured between 1992 and 1995 that will not meet the CARB emission standards and will therefore need to be replaced.
Reason for Recommendation: Under the proposed Agreement # 09-52818, Pape´ Machinery will furnish all materials, parts, incidentals, labor, equipment and services necessary to remove existing portable engines and provide and install new CARB certified portable engines in four units of Department of Transportation equipment. Under the supervision of the Fleet Services Manager, the contractor will perform the installations and dispose of the engines that are removed in compliance with CARB requirements. If the engines are not replaced, this critical road maintenance equipment will have to be taken out of service because it will be out of compliance with regulations.
A Non-Competitive Bid Purchase Justification was submitted for the purchase of the John Deere engines to be installed under the Agreement and was approved by the Purchasing Agent on December 8, 2009.
This is a one-time project to comply with state-mandated diesel particulate matter reduction regulations and is not a workload that will be sustained. While the total contract amount is $72,234, the labor portion is only $12,500 with the balance being for the engines. Department of Transportation staff in the equipment shop are fully tasked with repair and preventive maintenance of vehicles and equipment. While the skills to perform the work are contained in County classifications, existing staff does not have the capacity to perform the work for this one-time project.
Operating Engineers Local Union No. 3, AFL-CIO and the Human Resources Department were informed of the proposed Agreement on December 15, 2009. Human Resources approval was received on January 5, 2010.
The Department requests the Board make findings pursuant to Article II, section 210 b (6) of the El Dorado County Charter that the ongoing aggregate of the work performed under this Agreement is not sufficient to warrant the addition of permanent staff.
Action to be taken following Board approval: Agreement # 09-52818 will be signed by the Board Chair and one original will be forwarded to the Department of Transportation for further processing.
