DISCUSSION / BACKGROUND
On September 24, 2019, your Board ratified the Purchasing Agent signature on the Customer Signature Page, Contract Amendment, and Statement of Work as they relate to the Master Services Agreement to Contract 4251 with Relias Learning, LLC, for the provision of web-based education and information resource subscription services for inmates housed in both County Jails for a term of 7 years and an amount not to exceed $82,116.45. At the time, the vendor's name had been incorrectly entered in FENIX as Bertelsmann Learning LLC and the Contract number was changed to #4437.
Initially, the Sheriff’s Office executed Contract #2214 with Relias Learning for a term of 15 months starting December 1, 2017. Following completion of Contract #2214, the decision was made that a new contract should be implemented increasing the length of service. Contract #4437 included a seven (7) year term, which was beyond the Purchasing Agent signature authority as provided in Board of Supervisors Policy C-17, Section 4.5 “Contract Term,” hence requiring Board approval for the new contract.
Given the length of the Contract, Relias Learning had agreed to set pricing for the next seven (7) years for a total cost of $82,116.45 with 95 users. This Amendment I will increase the number of users from 95 to 100 and a provide for a corresponding increase of $3,845.01 for a revised not-to-exceed amount of $85,961.46 for the additional users.
Due to the set pricing provided by Relias Learning, this contract is in accordance with County Ordinance Section 3.13.030 as it is more economical and feasible to engage an independent contractor for said services.

FINANCIAL IMPACT
While the costs of the contract is increasing by $3,845.01, there is no impact to Net County Cost as sufficient appropriations were included in the Fiscal Year 2020-2021 budget and will be included in the budget for the remainder of the Contract.
