DISCUSSION / BACKGROUND

The TED Area Plan is a comprehensive, long-term planning document that will update and incorporate the Meyers Area Plan and other communities in the Tahoe Basin area of the County. Its goals include simplifying the permitting process, streamlining environmental review, and ensuring consistency between the County’s Zoning Ordinance and TRPA’s Plan Area Statements, while advancing objectives such as accelerating infill development, expanding housing choice, increasing supply and availability, affirmatively furthering fair housing, and reducing vehicle miles travelled. Development of the TED Area Plan is a multi-year, multi-phased effort that began in 2024 and is anticipated to conclude in 2027 with adoption by the Board of Supervisors (Board).

 

TRPA remains committed to supporting the County in developing the TED Area Plan and has agreed to reimburse the County up to $66,666 in REAP grant funds to help fund Phase 3 of the process. Phase 3 is expected to commence soon and entails finalizing the draft TED Area Plan, conducting environmental review, providing a public comment period, and holding public hearings for possible adoption of the document.

 

Due to the complexity of producing an area plan, the County has not yet commenced Phase 3 as originally anticipated. With the Cooperation Agreement nearing termination, and TRPA’s funding to the County set to expire, the County is requesting Amendment 1 to Cooperation Agreement 9331 (TRPA Contract 24C00026). This Amendment extends the termination date by approximately six (6) months from June 30, 2026 to December 31, 2026, providing additional time to finalize the document and expend funds. Additionally, the Amendment proposes replacing Exhibit A: Services and Products, with Amended Exhibit A: Amended Services and Products, expanding the allowable use of funds to enable the County to request funding for additional tasks within Phase 3 of the TED Area Plan development process. This Amendment ensures that the County can fully utilize this funding opportunity to advance the development of the TED Area Plan.

 

 

ALTERNATIVES

The Board may choose not to approve the proposed Amendment to Cooperation Agreement 9331. This action could jeopardize the County’s opportunity to expend the full $66,666 in REAP grant funds provided by TRPA to support Phase 3 of the TED Area Plan planning process.

 

PRIOR BOARD ACTION:

On October 8, 2024 (Legistar file 24-1532), the Board approved and authorized the Chair to execute Agreement 9035 with Ascent to assist the County with Phases 2 and 3 of the TED Area Plan, with a not-to-exceed amount of $982,889, and a term effective upon execution and expiring June 30, 2027.

 

On May 13, 2025 (Legistar file 25-0179), the Board approved and authorized the Chair to execute Cooperation Agreement 9331 between County and TRPA for a contribution of $66,666 in REAP grant funds from TRPA towards the TED Area Plan, with a term effective upon execution and terminating June 30, 2026.

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

County Counsel and Risk Management have approved the proposed Amendment.

FINANCIAL IMPACT

There is no change to Net County Cost associated with this Cooperation Agreement. TRPA will reimburse the County for Phase 3 TED Area Plan efforts up to $66,666. Phase 3 of the TED Area Plan is expected to occur during Fiscal Year 2025-26 and will extend into Fiscal Year 2026-27. Expenditures and revenues associated with the TED Area Plan have been included in the Fiscal Year 2025-26 budget and will be incorporated into the subsequent year’s budget.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair’s signature on two (2) original copies of Amendment 1; and

2) The Clerk of the Board will forward one (1) fully-executed original of Amendment 1 to the Chief Administrative Office, Procurement and Contracts Division, for further processing.
