DISCUSSION / BACKGROUND

A request has been submitted by Grant Parker and Kelly Parker, Trustees, or their Successors in trust, under The Grant and Kelly Parker Living Trust, dated October 10th,1997, owners of Assessor Parcel Number 092-440-013, together with approval from Martyn Johnson and Lynne Johnson, owners of Assessor Parcel Number 092-440-014 (Parcel 3), requesting that the County of El Dorado, Board of Supervisors, vacate the entirety of the 25’ non-exclusive road easement encumbering said property. The road easement is more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution.

 

The 25’ non-exclusive road easement, as shown on Parcel 2 of Parcel Maps Book 4 Page 141, was created by Michael H. Carlson and Samuel E. Gillion on November 19th, 1973. The easement was never offered; therefore, it was neither rejected or accepted by the County of El Dorado, and the map recorded on November 19th, 1973.

 

Martyn Johnson and Lynne Johnson, owners of Parcel 3, have not used said 25’ non-exclusive road easement for the purpose for which it was dedicated and find no present or future need exists for that road easement and do not object to its vacation, and to that end, has issued a letter to that effect.

FINANCIAL IMPACT

The Surveyor’s Office collects a fee for processing the Abandonment of Easement on a time and materials basis. There is no fiscal impact as a result of the approval of this item.

 

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the one (1) Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution for further processing to the Surveyor's Office, Attn: Carter Meyers.
