Surveyor's Office recommending the Board: Adopt and authorize the Chair to sign Resolution 231-2019 for Abandonment of Easement 19-0004; to abandon a portion of a public utility easement on Lot 12, as shown on the final map of The Promontory Village No. 2, recorded in Book I of Subdivisions at Page 135, identified as Assessor’s Parcel Number 124-120-012 in the community of El Dorado Hills, Supervisorial District 1.

DISCUSSION / BACKGROUND

A request has been submitted by Mohammadreza Dastoori and Sahar Anjomshoaa, owners of Assessor Parcel Number (APN) 124-120-012, requesting that the County of El Dorado, Board of Supervisors, vacate a portion of a public utility easement located on the subject property. Said easement is more particularly described in Exhibit A, and depicted on Exhibit B, of the attached Resolution. 

 

The public utility easement, as shown on Lot 12 of The Promontory Village No. 2, recorded at Book I of Subdivisions at page 135, was offered to the County of El Dorado by Reynen and Bardis (Promonotory), LLC, a California Limited Liability Company, on May 9, 2002, and Russell-Promontory, LLC, an Illinois Limited Liability Company, on March 28, 2002. The easement was acknowledged and accepted by the County of El Dorado on September 10, 2002, and the Subdivision Map recorded on September 11, 2002.

 

ALTERNATIVES
An alternative would be to not adopt Resolution of Abandonment of Easement 19-0004. By utilizing this alternative, the owner of Assessor Parcel Number 124-120-012 would be unable to pursue any development that would impact this easement.

 

PRIOR BOARD ACTION

OTHER DEPARTMENT / AGENCY INVOLVEMENT

AT&T, Comcast, El Dorado Irrigation District, and Pacific Gas & Electric have not used said portion of said easement for the purpose for which it was dedicated and find no present or future need exists for said easement and do not object to its vacation, and to that end, have all issued letters to that effect.

 

CAO RECOMMENDATION / COMMENTS

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

The Surveyor's Office collects a fee for processing the Abandonment of Easement on a time and materials basis.  There is no fiscal impact as a result of the approval of this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the one (1) Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution for further processing to the Surveyor's Office, Attn: Jane McClusky.
