Community Development Agency, Transportation Division, recommending the Board consider the following for the Sly Park Road at Clear Creek Crossing - Bridge Replacement Project, CIP No. 77115:
1) Approve and authorize the Chair to sign the Acquisition Agreement for Public Purposes to acquire the necessary Fee and Easements from APN #079-030-16 with title held as Michael S. Prall and Susan M. Prall, Co-Trustees of the Prall Family Trust Dated July 28, 2006;
2) Authorize the Community Development Agency Director, or designee, to execute the escrow instructions and any other related escrow documents pertaining to the transaction, including payment of title and escrow fees; and
3) Authorize the Community Development Agency Director, or designee, to extend the date of closure of escrow upon mutual agreement of both parties if necessary.
FUNDING: 2004 GP TIM, Highway Bridge Program and Regional Surface Transportation Program Exchange Funds - Caltrans. (Federal Funds)

DEPARTMENT RECOMMENDATION:
Community Development Agency, Transportation Division (Transportation) recommends that the Board Chair sign the Acquisition Agreement for Public Purposes for the Sly Park Road at Clear Creek Crossing - Bridge Replacement Project (Project). The area being acquired is necessary to construct the Project.
DISCUSSION / BACKGROUND:
The existing bridge was built in 1936 and is now sub-standard in its design with current road usage. Recent inspections indicate scour problems with the bridge's footings and abutments. Due to functional obsolescence, rehabilitation of the existing bridge is infeasible.
This Project will replace the existing bridge on Sly Park Road at Clear Creek, as well as realign and widen approximately 965 feet of Sly Park Road. A two-way left-turn lane will be included to improve safety onto and off of Clear Creek Road. The Project will also improve drainage along Sly Park Road.
The Board of Supervisors approved the CEQA document for this Project on September 14, 2010, item number 18.

County Counsel has approved the Acquisition Agreement.
CAO RECOMMENDATION:
CAO recommending the Board move forward with Staff's recommendation as the action is consistent with the approved CIP project.
FINANCIAL IMPACT:
The cost of the Fee and Easements for the parcel is $2,970 and the costs for the title and escrow fees are estimated at $2,500; therefore, the total cost is estimated at $5,470.00. Funding for Right of Way acquisition is budgeted in the Capital Improvement Program and will be provided by a combination of 2004 GP TIM, the Highway Bridge Program, and RSTP Exchange Funds - Caltrans. This Project has no Net County Cost.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair's signature on one (1) copy of the the Acquisition Agreement for Public Purposes and the four (4) Certificates of Acceptance for the Grant Deed and Easement Deeds.
2) The Clerk of the Board will return one (1) copy of the fully executed original agreement to Transportation for final processing.
3) The Clerk of the Board will return the Certificates of Acceptance and the executed Grant documents to Transportation for final processing.
