Fiscal Impact/Change to Net County Cost:
The Health and Human Services Agency included $198,302.16 for this renewal in its FY 2011/2012 budget and will include funds in its FY 2012/2013 and FY 2013/2014 budget requests for the remaining term of Amendment III to Lease Agreement #046-L9611.
 
Background:
The Health and Human Services Agency has leased this facility since 1995.  On October 31, 1995 the Board approved Lease Agreement #046-L9611 for a term ending December 31, 2002 with the option for three additional one-year terms ending December 31, 2005.  On March 15, 2005 the Board approved Amendment I to Lease Agreement #046-L9611 for a term ending December 31, 2010 with the option for three additional one-year terms ending December 31, 2013.  On December 14, 2010 the Board approved Amendment II to Lease Agreement #046-L9611 (reference Legistar # 10-1149) exercising the first option to extend the term one additional year to December 31, 2011, eliminating the 2% annual increase and requiring the Lessor to provide and pay for snow removal services.
 
Reason for Recommendation:
The Health and Human Services Agency has expressed the need to exercise the second and third options to extend Lease Agreement #046-L9611 for two additional one-year terms.  Amendment III to Lease Agreement #046-L9611 extends the term to December 31, 2013 and requires the Lessor to make necessary modifications to the client access area of the building to comply with the Americans with Disabilities Act.  
 
Action to be taken following Board approval:
1. The Chair will sign the two originals of Amendment III to Lease Agreement #046-L9611.
2. The Clerk of the Board will forward one fully executed original of Amendment III to Lease Agreement #046-L9611 to the Department of Transportation for further processing.
