There is no fiscal impact associated with this item.  There is no cost to the County General Fund.
 
Background:
The Department initiated the Christmas Valley Erosion Control Project to address water quality concerns in the Christmas Valley area in 2001 (EIP # 708, 709 and 190).  During the assessment of the area in 2002, it was apparent that the Christmas Valley Project area needed to be separated into two distinct Project Phases.  The first Phase (EIP # 709), which is known as the Grass Lake Road area, is considered a low-density residential rural subdivision, with major Upper Truckee River tributaries (Grass Lake Creek and Big Meadow Creek) (See attached Figure A).  The second Phase (EIP # 708 and #190) is also considered a low-density residential area along Highway 89 in the southern end of the basin, south of Meyers, but with the Department and Caltrans maintenance yards and various commercial and minor industrial land uses. This request only pertains to Phase 1.
 
Reason for Recommendation:
Phase 1 of the Project includes the Grass Lake Road area which consists of Grass Lake Road, Grass Lake Way, and Portal Drive and is bounded by State Highway 89 to the east and Upper Truckee River to the west.  The Project consists of the construction of erosion control/water quality improvements along with improvements to enhance the SEZ in the Project area. Since the erosion control and SEZ elements are interconnected within this area; the Department believes that solutions for the SEZ will also provide erosion control benefits.  Therefore, the two elements will complement each other and should provide an overall water quality benefit to the Christmas Valley Phase 1 area.  
 
Erosion control/water quality improvements consist of sediment traps, culverts, channels, slope revegetation and stabilization, flow spreading devices, and curb and gutter.  The SEZ improvements consist of adding meandering channels, rock check dams, and flow spreading devices.  Easements on private property will be necessary in order to construct some of these improvements.  The following four permanent easements from the following owners have been identified:

The attached Figure A is a Location Map showing the Project area and the parcels listed above.  The attached Figures B-1 through B-3 associates the parcels with the respective owner's names and shows the approximate locations of the acquisitions.
 
Certification for the Project environmental document was heard as a separate item at the October 24, 2006  Board meeting.  This requested Board authorization is necessary to fulfill legal requirements should the acquisition process result in the need to use the eminent domain process on any of the subject parcels.
 
Action to be taken following Board approval:
Upon authorization of the recommended action, Department staff will contact the respective property owners to discuss the Project needs and begin negotiations to secure the necessary easements.
