DISCUSSION / BACKGROUND

The California Mitigation Fee Act (Cal. Gov. §66000 et seq.) provides for the establishment of fees to mitigate the impacts of new development on public facilities in order to maintain the established level of service.  Individual Special Districts do not have the authority to establish these fees; as a result, the County establishes fees on behalf of the districts.  In accordance with the Mitigation Fee Act, these revenues are segregated and deposited into a separate account for each district.

 

Each request is needed in order to expand services based on the demand created by new development. The District’s request and link of reasonable relationship to their Nexus Study is attached.  In accordance with the District's impact fee nexus study, new apparatus, vehicles, equipment, and facilities may be funded 100% by impact fees, and replacement apparatus, vehicles, equipment, and facilities may be funded 26.5% by impact fees.

 

REPLACEMENTS
1. 2022 Dodge Ram 2500 (VIN 27166): Retrofitting of the Deputy Chief replacement vehicle purchased in FY 2022/23 - $26,265.14
2. 2023 Ford Explorer (VIN 10209): Replacement of a Community Risk Reduction Division vehicle, lettering, and striping - $13,744.68
3. 2018 Dodge Ram 3500 (VIN 66745): Retrofitting of the Training Captain replacement vehicle purchased in FY 2022/23 - $16,437.30
4. 2022 Dodge Ram 2500 (VIN 50467):
Retrofitting of the Battalion Chief replacement vehicle purchased in FY 2022/23 - $15,901.70

1. Training Center: Closeout construction costs and equipment - $351,586.34
2. 2023 Ford Explorer (VIN 81011): New Community Risk Reduction Division vehicle (1 of 2 added due to growth in the District) - $53,577.34
3. 2023 Ford Explorer (VIN 12930): New Community Risk Reduction Division vehicle (2 of 2 added due to growth in the District) - $51,866.71
4. 2004 Pierce Rescue Engine (VIN 04216): Tools and retrofitting of a new rescue engine donated to the Department by the City of Sacramento. This is an addition due to growth in the District and a corresponding increase in the risk of incidents requiring special rescue apparatus and equipment - $35,590.96
5. Station 91 Expansion Septic System Upgrade: The expansion of Station 91 was necessitated by the District's growth. The original septic system was designed for a volunteer-staffed station. With the station now operating with 24-hour staffing, an upgraded septic system is essential to meet current operational demands - $3,500

 

The development impact fees were last revised by the County on the District's behalf on December 6, 2022 (Legistar file 22-2032) via Resolution 171-2022.

 

The County has entered into an agreement with the District, whereby the District agrees to "hold County harmless and defend County and its employees, officers, and agents from any claim, liability, or action" resulting from the County’s calculation, imposition, and collection of impact fees on the District’s behalf.

 

The Chief Administrative Office recommends the disbursement of funds for the above-described uses because they are consistent with the purpose for which the fee was collected, the District and County are currently in compliance with the Mitigation Fee Act, and the indemnity agreement between the District and the County sufficiently protects the County from potential liability related to the disbursement.

FINANCIAL IMPACT

There is no fiscal impact on the County. Impact mitigation fees are collected by the County on behalf of the district and held in a separate account. The account balance as of December 11, 2024, is $5,138,385.49.
