Transportation Department recommending Chairman be authorized to sign Agreement for Services AGMT 07-1596 with David Evans and Associates, Inc., in an amount not to exceed $1,850,000 for a term effective upon execution and expiring upon the later of County's recordation of the Notice of Completion for the U.S. 50/Ponderosa Road/South Shingle Road Interchange Improvements Project or resolution of all construction claims, if any, associated with that Project to perform professional services including project planning, design engineering and project delivery support services for the interchange and associated improvement projects; and adopt recommended findings pertaining to same. Fiscal Impact/Change to Net County Cost:
Funding for this contract is provided through the 2004 General Plan Traffic Impact Mitigation Fee Program (TIM). The TIM fund is projected to have sufficient monies to advance this project through the Project Report (PR) stage. With the information to be derived from the PR, the County will be able to more accurately determine alignments and estimated costs for the interchange and thereby have the information necessary to develop financing strategies related to funding for the right of way and construction phases of the project. The PR information will be important related to the Department's ability to pursue grant funding or to evaluate the potential for funding through a Community Facilities Districts.
The contract with David Evans includes a not to exceed amount of $1.85 million, where this amount is sufficient to provide for the PR, and to also provide for design and construction support. Even though the contract amount is for the amount of $1.85; the first task order issued will be limited to $600,000, which will be sufficient to fund through the PR. The balance of the contract will be utilized only when additional funding is identified. Including the entire amount of $1.85 million in the contract will allow the Department the flexibility to respond with new task orders if the needed funding is identified.
The requested action will have no impact to the General Fund Net County Cost.
Reason for Recommendation:
The US 50/Ponderosa/South Shingle Road Interchange Improvements Project (# 71333) (Project) is included in the Department's Capital TIM and includes preparation of the Project Study Report/Project Report, preparation of the Environmental Document, Plans Specifications & Estimates and construction support of the ultimate interchange improvements with phased construction. The interchange improvements will also include significant local road improvements for circulation and improved level of service such as North Shingle Road and Durock Road Realignments.
In December 2004, the Department of Transportation (Department) solicited the engineering community for Statement of Qualifications for Interchange and Roadway Projects. On November 8, 2005, the Board of Supervisors approved the Department's consultant selection and authorized staff to negotiate a contract with David Evans and Associates, Inc. (Consultant) for engineering/environmental services. The Department entered into Agreement (AGMT 05-938) approved by the Board on February 14, 2006. Agreement #AGMT 05-938 expires on February 13, 2008 and the Department will have expended approximately $210,000 of the $2,000,000 encumbered for this Agreement. On Tuesday, April 17, 2007, the Board approved Item 30 which included authorization for the Department to negotiate a new agreement with Consultant to provide professional services for this Project.
The Department is recommending that the Board make findings pursuant to Article II, Section 210b, (6) of the El Dorado County Charter that there are specialty skills required for the work performed under this Agreement that are not expressly identified in County job classifications. Expertise provided through this contract include but are not limited to freeway geometry, bridge design, geotechnical engineering, and specifically including coordination with Caltrans and an intimate understanding of Caltrans' requirements.
Concurrences:
The Purchasing Agent has determined that it is appropriate to enter into a contract with David Evans and Associates, Inc. based on prior action taken by the Board of Supervisors. The Purchasing Agent concurs that the Department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.5 and 7.10.
The El Dorado County Employees Association, Local #1 has been informed of this proposed Agreement.
Action to be taken following Board approval:
1. The Board Chairman will sign two originals of Agreement for Services # AGMT 07-1596 with David Evans and Associates, Inc.
2. The Board Clerk will forward one original of the fully executed Agreement to the Department for further processing.
