DISCUSSION / BACKGROUND
A Notice of Vacancy was posted by the Clerk of the Board on September 23, 2025, in accordance with the requirements outlined in Public Resources Code section 9314(b)(1) and Government Code section 54974. The notice was made publicly available to inform interested parties of upcoming vacancies and to invite applications for appointment.
The terms of two current members, Jason Burke and Kathleen McIntyre, are scheduled to expire on November 9, 2025. Both individuals have expressed their interest in continuing to serve and have requested reappointment to their respective positions. During the posting period, no additional applications or expressions of interest were received.
Given the absence of new applicants and the willingness of the incumbents to continue their service, the Board may consider reappointing Mr. Burke and Ms. McIntyre to new terms beginning November 10, 2025, in order to maintain continuity and preserve institutional knowledge within the body.
The Clerk of the Board received recommendations from both the Tahoe Resource Conservation District (RCD) and Supervisor Laine to reappoint Jason Burke and Kathleen McIntyre to the Board of Directors of the Tahoe Resource Conservation District. If reappointed, each director would serve a four-year term.
The Tahoe RCD was established by the California State Legislature in 1974. PRC section 9314(b)(1) provides an alternative to an election of Tahoe RCD directors if they adopt a resolution which is subsequently presented to the Board of Supervisors of the principal county requesting the Board appoint Tahoe RCD directors. The Tahoe RCD passed Resolution 90-2 on June 12, 1990, "which as an alternative to the election of directors, board of directors may, by resolution present to the Board of Supervisors of the principal county, request the Board of Supervisors to appoint directors, except those first elected." Pursuant to Tahoe RCD Resolution 90-2, an election is not necessary.
Note that PRC section 9314(b)(4) states in full, "If the Board of Supervisors does not conduct interviews of potential candidates or make an appointment within 60 days after the expiration of the term, the board of directors may make the appointment."
