Fiscal Impact/Change to Net County Cost:   There is no Net County Cost associated with this Amendment 4 to Agreement 7275-07/12-709 with Sacramento County.  In anticipation of this Amendment 4, the Department included this funding in the fiscal year (FY) 2010-11 budget.
 
Background:   Congress created the Ryan White CARE Act in 1990, named for Ryan White, a teenager who contracted HIV through a blood transfusion and died after an eight-year struggle with the disease.  The Ryan White CARE Act is a series of grant programs that fund treatment services for people with HIV/AIDS who are either uninsured or underinsured.  Since its creation, the Act has been reauthorized multiple times, the latest being October 2009.
 
Sacramento County is the applicant/recipient for the Ryan White CARE Act funds for the eligible metropolitan area (EMA) and serves as the fiscal agent distributing those funds to various counties including the County of El Dorado.  Ryan White Program services include, but are not limited to, information, referrals and/or arranging for outpatient medical care, skilled nursing, medication management, diagnosis and treatment of common medical, dental and mental health conditions, as well as addressing nutritional issues to include direct food purchases.  The County subcontracts with Sierra Foothills AIDS Foundation for the Ryan White Program.  The Health Services Department has a longstanding and successful relationship with Sierra Foothills AIDS Foundation, a community-based agency specializing in services to individuals and families afflicted with HIV/AIDS.
 
Compensation for Services:   Reimbursement within thirty (30) days of receipt of invoices based on actual services performed and documented per contract requirements, with final reconciliation via a post-Agreement audit.
Contract Termination:   Sacramento County may terminate this Agreement immediately upon giving written notice to El Dorado County for: 1) delay or suspension of external funding; 2) if funds for this program are not appropriated by the State; 3) if funds in Sacramento County's annual budget are not appropriated for this Agreement; or 4) if funds previously appropriated for this Agreement are reduced, eliminated or re-allocated as a result of mid-year budget reductions.
Retroactive Term:   Upon receiving Amendment 4 to Agreement 7275-07/12-709 in September  2010, the Department promptly began processing the Amendment through Department and County review processes.  All reasonable efforts were made to bring the Amendment before the Board as quickly as possible.
 
Reason for Recommendation:   Approval of this Amendment will allow the County to continue receiving Federal Ryan White CARE Act funding that supports the provision of medical care and services to individuals and their families afflicted with HIV/AIDS.  
 
Action to be taken following Board approval:
1. Chair to sign all five (5) signed Amendments 4 to Agreement 7275-07/12-709.
2. Department to submit one (1) certified minute order of this Board item and all signed originals to Sacramento County for final execution.
3. Upon receipt of fully executed documents from Sacramento County, Department to return one (1) fully executed original to the Board Clerk's Office.
