Title

HEARING - Planning and Building Department, Planning Division, recommending the Board consider the Planning Commission’s recommendation to approve the Diamond Springs Community Park rezone project (Rezone Z24-0005) requesting the rezone of two (2) residentially zoned parcels to Recreational Facilities, High-Intensity (RFH) for use as a community park. 5225 for Rezone Z24-0005, rezoning from Single-Unit Residential (R1) and One-Acre Residential (R1A) to Recreational Facilities, High-Intensity (RFH) (Attachment B).

DISCUSSION / BACKGROUND

On December 12, 2023 (Legistar file. 23-2024), the Board approved Diamond Springs Community Park, as described in the Final Environmental Impact Report (FEIR), on two largely undeveloped parcels (331-301-019, 331-400-002); approved and certified the corresponding FEIR; adopted the Findings of Fact; incorporated the Mitigation Monitoring and Reporting Plan (MMRP) for the project; formally accepted the donation of the property identified by APN 331-400-002 and authorized the Board Chair to sign the Certificate of Acceptance; authorized and directed staff to proceed with filing the Notice of Determination for the project; and directed staff to move the project forward.

 

On February 27, 2024 (Legistar file 24-0312), the Board approved the recommendation of the Chief Administrative Office, Parks Division, to authorize the Chief Administrative Officer, or designee, to enter into negotiations with the Boys and Girls Club for the property identified by APN 331-400-002, located at 3447 Clemenger Drive, Diamond Springs, for the purpose of developing a park in Diamond Springs.

 

On May 21, 2024 (Legistar file 24-0738), the Board adopted Resolution 081-2024 to declare the County-owned parcel APN 331-400-002-000 as exempt surplus land per Government Code Section 54220-54234.

 

On June 18, 2024 (Legistar file 24-1009), the Board adopted Resolution of Intention 108-2024 to amend Title 130 of the County Zoning Ordinance by 1) amending the Zoning Map to rezone parcel APN 331-301-019-000 from R1 to RFH and 2) amending the Zoning Map to rezone parcel APN 331-400-002-000 from R1A to RFH.

 

Since February 2024, the County has been engaged in negotiations with Boys and Girls Club to transfer ownership of the land (APN 331-400-002) and development and operation of the park to Boys and Girls Club.

 

On January 23, 2025, (Legistar file 25-0070) the Planning Commission recommended to the Board of Supervisors take the following actions: 1) Adopt the Addendum to the Diamond Springs Community Park FEIR, which was certified in December 2023 (State Clearinghouse No. 2023050469), prepared in accordance with the CEQA Guidelines; and 2) Approve Rezone Z24-0005, based on the Findings as presented. The motion passed with a 5-0 vote.

ALTERNATIVES

The Board could choose not to approve the proposed Rezone Ordinance to amend the Zoning ordinance, which would delay or impede the ability to develop the Diamond Springs Community Park.

FINANCIAL IMPACT

There is no change to Net County Cost associated with this item. The Board allocated $1 million of Discretionary Transient Occupancy Tax (DTOT) funds with the Fiscal Year 2022-23 Recommended Budget toward the development of the project. The Board directed the funds from the sale of the Bass Lake Property ($250,000) to be set aside and eventually allocated to the Diamond Springs Community Park. The Board allocated an additional $50,000 in General Fund to cover the cost of the CEQA analysis (Legistar file 22-0472), approved the use of $142,372 of the $1 million in DTOT for the amended scope of the Dudek contract (Legistar file 23-0089, April 4, 2023), and approved the use of a portion of the remaining DTOT for the rezone (Legistar file 24-1009). On January 7, 2025, the Board approved a contract with Kimley Horn for engineering and permitting services, funded by $558,700 of the remaining DTOT funds (Legistar file 24-1763). Staff time spent on this rezone process is also to be billed to the DTOT allocation.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk to obtain the Chair's signature on the original copy of the Rezone Ordinance.

2) Clerk to send one (1) fully executed copy of the Rezone Ordinance to the Planning and Building Department, attention of Rhiannon Guilford.
