1) Accept a donation in the amount of $3,400 in Fiscal Year (FY) 2023-24 from Alison Winter on behalf of the residents of the King of the Mountain Zone of Benefit (Zone) to continue to fund Zone operations;
2) Approve and authorize the Chair to sign a Funding Agreement with Alison Winter in the amount of $3,400 for FY 2023-24; and
3) Approve and authorize the Chair to sign a Budget Transfer adjusting the King of the Mountain Zone of Benefit 98138 budget for FY 2023-24. (4/5 vote required)

DISCUSSION / BACKGROUND
On December 30, 1986, the Board of Supervisors formed the King of the Mountain Zone of Benefit No. 98138 (Zone) by Resolution 403-86 to provide road improvement and maintenance services. For the first time since the formation of the Zone, expenditures for services will exceed the annual revenue. After a thorough evaluation, the increased need for snow plowing services during the 2022-2023 Winter Storms was shown to be the major contributing factor.
Per Government Code Section 25355, the Board may accept or reject any gift, bequest, or devise made to or in favor of the County, or to or in favor of the Board in trust for any public purpose. The Board may delegate to any County officer or employee the power to accept any gift, bequest, or devise made to or in favor of the County. The officer or employee shall file with the Board each quarter a report that describes the source and value of each gift valued in excess of ten thousand dollars ($10,000) or any other amount as determined by the Board. The Board may hold and dispose of the property and the income and increase thereof for those lawful uses and purposes as are prescribed in the terms of the gift, bequest, or devise. In accounting for or inventorying gifts, bequests, or devises, the officer or employee shall follow the appropriate procedures contained in the State Controller's manual entitled “Accounting Standards and Procedures for Counties.”
The King of the Mountain Zone of Benefit has agreed to donate funds to the County for the purpose of funding Zone operations. In accordance with the Funding Agreement, $3,400 will be accepted for Fiscal Year 2023-24.
The Key Contact of the Zone has indicated there will be a forthcoming election request to replace the current assessment amount of $250 per parcel with an increased annual special tax. Following the receipt of this request, the Department of Transportation will bring an item to the Board for consideration to approve a resolution setting a measure for either a Special Election or the November 5, 2024, Presidential Election.
ALTERNATIVES
The Board may choose not to approve the donation, limiting the Zone's ability to continue receiving snow plowing services within the Zone of Benefit.

FINANCIAL IMPACT
The estimated revenue for FY 2023-24 is $5,250 based on 21 parcels with a $250 annual assessment. Accepting the $3,400 donation and approving the Budget Transfer would allow additional funding to cover snow plowing services in FY 2023-24, and allow the zone to end the current fiscal year with a positive budget balance.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair’s signature on two (2) originals of the Funding Agreement.
2) The Clerk of the Board will provide one (1) original copy of the Funding Agreement to the Department of Transportation, attention of Elizabeth Hess.
3) The Clerk of the Board will obtain the Chair's signature on the original budget transfer and will forward the budget transfer to the Auditor/Controller for processing.
