Fiscal Impact/Change to Net County Cost:  There is no Net County Cost associated with this Agreement.
 
Background:  On November 11, 2009, the Board of Supervisors approved Grant 2009-DC-BX-0076 with The Department of Justice, Office of Justice Programs, Bureau of Justice Assistance for $200,000 with a term September 1, 2009 through August 31, 2011.  This Drug Court Discretionary Grant Program award provides funding to enhance the DUI Court Expansion program.
 
This Agreement with Progress House provides funding for a comprehensive continuum of substance abuse treatment for persons who are referred to the program by the DUI Court Coordinator (as assigned by the County Alcohol and Drug Program Manager).   
 
Compensation for Services:  Payments are made to Contractor based upon monthly invoicing at specified billing rates for actual services performed and documented per contract requirements.  Services and rates are detailed in Exhibit G, Service Reimbursement Schedule.  
 
Contract Termination:  This Agreement includes the County's standard Fiscal Considerations termination language, as well as the County's standard provision for County to terminate the Agreement without cause upon seven (7) calendar days written notice.
 
Retroactive Term:  The Drug Court Discretionary Grant Program award was approved by the Board in November 2009; however, the term of the grant begins September 1, 2009 and expires August 31, 2011.  This Agreement 097-116-P-E2009 was very difficult for the Department to develop due to the length and complexity of the Agreement and the associated grant terms and conditions which are required to be part of the subcontract with Progress House.  Upon receipt at County Counsel, it was converted to a Legal Services request (versus a standard contract routing sheet request) for these same reasons.  Following County Counsel's review and approval, the Agreement was processed as expeditiously as possible.
 
The Health Services Department is recommending the term of this Agreement coincide with the grant term.   During the time the Department worked with all parties involved with development of the Agreement, Progress House has provided services to the clients eligible for the DUI Court Program in good faith.
 
Reason for Recommendation:  Approval of this Agreement will allow the County to continue providing substance abuse treatment services and counseling for persons referred for treatment through the DUI Court Expansion program.  Progress House is currently the only licensed local ADP providerr that offers both residential and transitional housing services (24/7).
 
Action to be taken following Board approval:
1. Chair to sign three (3) original Agreements 097-116-P-E2009.
2. Board Clerk's Office to return two (2) signed Agreements to Department.
3. Department to distribute documents as appropriate.
