Title

HEARING: Treasurer-Tax Collector Department recommending the Board conduct a public hearing to introduce and adopt Ordinance 5176 amending Title 3, Chapter 3.29 and Title 5, Section 5.05.030 of the El Dorado County Ordinance Code to add additional fees to cover the cost to provide additional services.

DISCUSSION / BACKGROUND

Chapter 3.29 of Title 3 and Section 5.05.030 of Title 5 of the El Dorado County Ordinance Code describe the services and products which the Treasurer-Tax Collector provides on a fee basis.  California Government Code Chapter 12.5 County Fees, Section 54985, authorizes the Board of Supervisors to “recover the cost of providing any product or service . . .” (Attachment B).  The Treasurer-Tax Collector Department updated its fee Ordinance in 2020 to align the fees more closely with the cost of providing services.

 

Included in this Fee Ordinance update are fees which are permitted by state law but were not collected up to this time.  Additionally included are fees which had been approved by Resolution but had not added to the Fee Ordinance.  Also, newly added fees include subscription fees for access to County’s file transfer protocol  (ftp) site for current and delinquent tax bill data.

 

California Gov. Code 25131 allows an ordinance which by statute can be passed only after notice and a public hearing may be introduced and passed at a single public hearing.  The proofs of publication are attached to this item.

 

ALTERNATIVES

The Board could choose not to approve this revised ordinance and continue to supplement Treasurer-Tax Collector products and services with General Fund dollars.

County Counsel has reviewed and approved the proposed Ordinance as to form.

Approve as Recommended.

 

FINANCIAL IMPACT

The estimated impact is approximately $255,000 annually. This amount has not been included in the Recommended Budget. Revenues will be evaluated during the Adopted Budget process and may be adjusted at that point.
