Title
Community Development Agency, Transportation Division, recommending the Board consider the following for the Sly Park Road at Clear Creek Bridge Replacement Project, CIP No. 77115:
1) Approve and authorize the Chair to sign the Acquisition Agreement for Public Purposes and the Certificate of Acceptance to acquire the necessary fee and easements from APN # 079-030-08 with title held under Starr E. Hallmark, as Trustee Under the Hallmark Living Trust Dated February 5, 2001;
2) Authorize the Community Development Agency Director, or designee, to execute the escrow instructions and any other related escrow documents pertaining to the transaction, including payment of title and escrow fees; and
3) Authorize the Community Development Agency Director, or designee, to extend the date of closure of escrow upon mutual agreement of both parties if necessary.
FUNDING: This project is funded by the Federal Highway Bridge Program, 2004 GP TIM funds and Regional Surface Transportation Program Exchange Funds. (Federal Funds)

DEPARTMENT RECOMMENDATION
Transportation recommends that the Board sign the Acquisition Agreement for Public Purposes for the Sly Park at Clear Creek Bridge Replacement Project (Project), CIP No. 77115. The fee and easements are necessary to construct the Project.
DISCUSSION/BACKGROUND
The existing bridge was built in 1936 and is now sub-standard in its design with current road usage. Recent inspections indicate scour problems with bridge's footings and abutments. Due to functional obsolescence, rehabilitation of the existing bridge is infeasible.
The Project will replace the existing bridge on Sly Park Road at Clear Creek, as well as realign and widen approximately 965 feet of Sly Park Road. A two-way left-turn lane will be included to improve safety for vehicles turning onto and off of Clear Creek Road. The Project will also improve drainage along Sly Park Rd.
The Board of Supervisors approved the California Environmental Quality Act document for this project on September 14, 2010 (Item No. 18).

CAO RECOMMENDATION
CAO recommending the Board move staff's recommendation as this is an approved CIP project and the actions requested are consistent with standard practice.
FINANCIAL IMPACT
The costs of the fee and easements are $4,000. The costs for the title and escrow fees are estimated at $2,500 for a total cost of $6,500. Funding for the Right of Way acquisition process is budgeted in the Capital Improvement Program and will be provided by the Highway Bridge Program, 2004 GP TIM funds and Regional Surface Transportation Program Exchange funds. This project presents no impact to the General Fund.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair's signature on two (2) copies of the Acquisition Agreement for Public Purposes and the Certificates of Acceptance for the Grant Deed, Grant of Slope and Drainage Easement and the Grant of Temporary Construction Easement.
2) The Clerk of the Board will return one (1) copy of the fully executed original Acquisition Agreement to Transportation for final processing.
3) The Clerk of the Board will return the signed Certificate of Acceptance and the executed Grant documents to Transportation for final processing.
