Fiscal Impact/Change to Net County Cost:
There is no cost to the County General Fund associated with this agenda item.
 
The cost associated for the construction phase of this project is estimated at $575,000, which included an estimated bid of $460,000, construction  management and materials testing at $69,000 and a contingency of $46,000.
 
Funding for this project is from the Regional Surface Transportation Program (RSTP) Exchange Fund - Competitive, through the El Dorado County Transportation Commission (EDCTC), in the amount of $575,000.
 
The RSTP Exchange program was set up to allow local government entities to exchange their Federally-allocated dollars for State funds, thereby permitting local agencies to utilize those funds without being subject to all of the Federal provisions (such as NEPA, Davis-Bacon, Copeland Anti-Kickback and EEO requirements). In its exchange agreements with local agencies however, Caltrans includes language that requires compliance with all of the Federal provisions. The Department has objected to the inclusion of that language for years. The Department has been partially successful in our objections to the inclusion of this language and has had Caltran's concurrence on prior agreements that the Title 49, Subtitle A, Part 18, Subpart C, Post Award Requirements, Changes, Property, and Subawards, and Section 18.36 (i), inclusive of Federal prevailing wage, NEPA, Copeland Anti-Kickback, EEO, etc. were not intended to and did not apply to funds exchanged under the Federal Apportionment Exchange Program Agreements. Accordingly, the Department has not included those provisions in our subrecipient contracts, but we have included the State fiscal principles and competitive procurement requirements in contracts that utilize RSTP exchange funds.
 
Given this information the Department is bringing to the Board's attention the risks involved in utilizing RSTP exchange funds without full compliance with the exchange fund agreements (i.e, including all of the Federal provisions in our contracts that utilize RSTP exchange funds). Although low, the potential risk is that Caltrans may deny the reimbursement of this project. If such a determinatiion is made, the County  would need to use Road Funds to pay for the project which could result in reduced overall road maintenance. It seems unlikely that Caltrans would now enforce those Federal provisions (although legally it could, until it changes the wording in its exchange agreements), since to do so would defeat the intent and purpose of the exchange program itself by subjecting the exchanged dollars to all of the Federal requirements.
 
Reason for Recommendation:
The project is a maintenance project to provide an asphalt overlay on Francisco Drive and Lakehills Drive in El Dorado Hills, and is included in the Department's Five-Year Capital Improvement Program which was presented to the Board of Supervisors in February 2007 and includes the following areas.
 
The section of Francisco Drive, from Village Center Drive to Templeton Drive, is a 0.88 mile segment and has an average daily traffic (ADT) of 10,000 vehicles per day. The section of Lakehills Drive, from Salmon Falls Road to Bonita Drive, is a 1.07 mile segment and has an average daily traffic (ADT) of 3,000 vehicles per day.
 
These two roads have a Pavement Condition Index (PCI) of 56 and 43 respectively of a maximum 100 (road in perfect condition). A PCI of 55 or lower requires a proportional amount of corrective maintenance to repair the road damage, in this case an AC overlay is recommended. DOT Maintenance personnel has completed the repair of the damaged pavement to improve the road structural condition.
 
The PCI calculation is determined by visual assessment and consists of the following factors: distress type (sinking depression, cracking, mushrooming etc.), severity (irregularity in driving surface and structural degradation), and quantity (amount of damaged surface area in 100 sq. ft. of roadway surface).
 
If these streets are not protected from future deterioration, they will require more extensive and expensive work in the near future.
 
Action to be taken following Board approval:
1. The Department will advertise for construction bids and return to the Board for consideration to award the construction contract, pursuant to the Department's recommendation.
2. Subsequent to approval of this agenda item, and successful award of the contract, the Department anticipates construction beginning in September 2007.
