DISCUSSION / BACKGROUND

The drug discount program established under Section 340B of the Public Health Services Act (the "340B Program") is a federal program that allows specific categories of safety-net providers, including some hospitals, clinics, and health centers, to procure outpatient prescription drugs at discounted prices. 

Marshall Medical Center participates in the 340B Program. To participate in the program, Marshall must enter into an agreement with the County pursuant to which Marshall commits to provide health care services to low-income individuals who are neither entitled to benefits under Title XVIII of the Social Security Act nor eligible for assistance under the State plan of Title XIX.

The requested non-financial Memorandum of Understanding (MOU) between the County and Marshall fulfills the 340B Program requirement by certifying Marshall’s commitment to provide health care to indigent, uninsured and underinsured residents of the County. Marshall and the County have a previously established MOU, dated May 6th, 2021, for Marshall’s eligibility in the 340B Program. However, the established MOU requires an updated signature for the current Acting Chief Administrative Officer. As the Agreement does not directly relate to EMS services, it is not covered under Board Policy C-18, Non-Financial Agreements and is being brought to the Board for approval.

 

ALTERNATIVES

Should the Board choose to deny the requested MOU, Marshall may not be eligible to participate in the 340B Program.
