Title
Health and Human Services Agency, Mental Health Division, recommending the Board consider the following:
1) Approve and authorize the Chair to sign Amendment II to Agreement for Services 022-S1310 with EDCA Lifeskills, Inc., extending the term through June 30, 2015, and increasing the maximum obligation of the Agreement to $331,526 to provide Alcohol and Drug Program counseling, prevention, and treatment services;
2) Approve and authorize the Chair to sign retroactive Amendment II to Agreement for Services 047-S1310 with New Morning Youth and Family Services, Inc., extending the term through June 30, 2015, and increasing the maximum obligation of the Agreement to $326,019 to provide Alcohol and Drug Program counseling, prevention, and treatment services;
3) Approve and authorize the Chair to sign Amendment II to Agreement for Services 024-S1311 with Tahoe Youth and Family Services, Inc., extending the term through June 30, 2015, and increasing the maximum obligation of the Agreement to $274,654 to provide Alcohol and Drug Program counseling, prevention, and treatment services; and
4) Authorize the Purchasing Agent to execute further documents relating to the above noted Agreements, including amendments thereto, contingent upon review and approval by County Counsel and Risk Management that do not affect the maximum dollar amount or the term.

Fiscal Impact/Change to Net County Cost
There is no Net County Cost associated with these Agreements. Sufficient appropriations are included in the Fiscal Year 2013-14 Budget and will be included in future budgets for the term of each Agreement.
Background
The Substance Abuse and Mental Health Services Administration (SAMHSA) is a branch of the U.S. Department of Health and Human Services, and is charged with improving the quality and availability of prevention, treatment, and rehabilitative services to reduce illness, death, disability, and cost to society resulting from substance abuse and mental illness. SAMHSA offers many grant opportunities, including the Substance Abuse Prevention and Treatment (SAPT) federal block grant, which the State receives and then contracts with local agencies to provide services through the Negotiated Net Amount (NNA) Agreement which includes SAPT funding, Drug Medi-Cal funding, and Behavioral Health Realignment to be used for substance abuse prevention and treatment services. Additionally, in 2011 the Governor signed Assembly Bill (AB) 109 and AB 117, to address prison overpopulation through local services, making available funding to the counties for additional substance abuse and treatment services specific to the corrections population.
The County of El Dorado has contracted with the State via the NNA Agreement, and other entities for various grants to secure substance abuse treatment funding since at least 1990, providing services to the community primarily through contracted service providers. These services, available 24 hours a day, seven days a week, include both residential and outpatient counseling and treatment.
On July 25, 2012, the Purchasing Agent approved Agreement 022-S1310 with EDCA Lifeskills, Inc. for the term July 1, 2012 through June 30, 2013, with a maximum obligation of $42,111 for the provision of Alcohol and Drug Program (ADP) counseling and treatment services. On September 10, 2013, the Board approved Amendment I to that Agreement, thereby increasing the maximum obligation by $94,415 for a total obligation of $136,526.
On August 14, 2012, the Board approved Agreement 047-S1310 with New Morning Youth and Family Services, Inc. for the term July 1, 2012 through June 30, 2013, with a maximum obligation of $75,157 for the provision of ADP counseling and treatment services. On September 10, 2013, the Board approved Amendment I to that Agreement, thereby increasing the maximum obligation by $35,862 for a total obligation of $111,019. The Health and Human Services Agency (HHSA) became aware in November that New Morning Youth and Family Services, Inc. had nearly depleted their allocations for SAPT funding, due in part to an increase in services provided at the Juvenile Hall that were more extensive than anticipated, resulting in this retroactive Amendment II to that Agreement.
On August 14, 2012, the Board approved Agreement 024-S1311 with Tahoe Youth and Family Services, Inc. for July 1, 2012 through June 30, 2013 with a maximum obligation of $89,827 for the provision of ADP counseling and treatment services. On September 10, 2013, the Board approved Amendment I to that Agreement, thereby increasing the maximum obligation by $89,827 for a total obligation of $179,654.
Early in fiscal year 2013, the County terminated services with one of the primary ADP service providers, resulting in redistribution of clients to other existing providers. Since that time, HHSA has identified higher than anticipated use of specific services, and determined the need to increase certain funding stream amounts to ensure ongoing availability of counseling and treatment services for existing clients.
Reason for Recommendation
The County has neither the facilities nor the staff available to meet these service requirements. Failure to contract with community-based alcohol and drug treatment providers would result in an inability to meet the service demands of the community, as well as an inability to provide the service levels mandated by the funding agreement(s). Approval and execution of the following three amendments will allow HHSA to continue to provide and maintain alcohol and drug counseling and treatment services for both existing and future clients. Said amendments include: (1) Amendment II to Agreement 022-S1310 with EDCA Lifeskills, Inc.; (2) Amendment II to Agreement 047-S1310 with New Morning Youth and Family Services, Inc.; and (3) Amendment II to Agreement 024-S1311 with Tahoe Youth and Family Services, Inc.
