Health and Human Services Agency (HHSA) recommending the Board:
1) Delegate the authority to the HHSA Behavioral Health Deputy Director to execute Non-Financial Memorandum of Understanding (MOU) 10270, and the applicable exhibits, with California Correctional Health Care Services Health Information Management for the provision of electronic data sharing services provided under MOU 10270 for a term of three years effective upon final execution; and
2) Authorize the HHSA Behavioral Health Director or Deputy Director to execute further documents relating to MOU 10270, including amendments which do not increase the maximum obligation or term of the MOU, contingent upon approval by County Counsel, Risk Management, and Information Technology Department, as applicable.

DISCUSSION / BACKGROUND
The purpose of this MOU is for the secure transfer of Personally Identifiable Information (PII)/Protected Health Information (PHI), and Health Insurance Portability and Accountability Act (HIPAA) data between CCHCS HIM and HHSA via CCHCS Secure File Transfer Portal (SFTP). CCHCS and HHSA will work collaboratively to facilitate the timely and efficient release of patient-inmate medical records between CCHCS HIM and HHSA for the purpose of ensuring continuity of care/coordination of care for medical, mental health, dental, and substance use disorder treatment. CCHCS and HHSA will work together to ensure secure transfer of PII/PHI and HIPAA.
MOU 10270 is a renewal of MOU 5291 approved by the Board on January 4, 2022 (Legistar file 21-1709). Per Board Policy C-18 Non-Financial Agreements, the Chief Administrative Officer has the authority to sign this MOU, however CCHCS has requested that the individual designated to serve as the Information Custodian on behalf of the County sign this MOU, which is the HHSA Behavioral Health Deputy Director. As the Information Custodian, the individual shall be responsible for the establishment and maintenance of privacy and security arrangements as specified in this MOU. The Information Custodian shall also ensure authorized staff complete all required privacy, security and data-protection training prior to being granted access to CCHCS systems or receiving any PHII/PHI under this MOU.
HHSA is requesting the Board approve this agenda item as delegating the signatory to the Behavioral Health Deputy Director will allow for a more streamlined and efficient process to ensure compliance with CCHCS and County network security protocols.
