Probation Department recommending the Board consider the following:
1) Make findings in accordance with Chapter 3.13, Section 3.13.030 County Ordinance, that it is more economical and feasible to continue to contract out to provide for the mental health needs of minors (wards) of the Probation Department as previously contracted through New Morning Youth & Family Services, Inc. Agreement 295;
2) Approve and authorize the Chair to sign Agreement 3249 with New Morning Youth & Family Services, Inc. for the provision of therapeutic counseling services. This agreement is for a three (3) year term beginning November 1, 2018, for a not to exceed amount of $287,400; and
3) Authorize the Purchasing Agent, or designee, to execute further documents relating to Agreement for Services 3249, including amendments which do not increase the maximum dollar amount or term of the Agreement, and contingent upon approval by County Counsel and Risk Management.

DISCUSSION / BACKGROUND
In November of 2011, the Probation Department engaged in services with New Morning Youth & Family Services, Inc. (NMY&FS) to provide for the mental health needs of minors (wards) housed for any period of time at Juvenile Hall pursuant to Title 15, California Code of Regulations, Standards for Juvenile Facilities. NMY&FS provides "Program Therapist(s)" for counseling, services, and support to the Probation Department Juvenile Detention Facility in Placerville. Therapists assess clients’ basic safety, and mental health, and apply appropriate interventions.
Staff is requesting Board of Supervisors make findings that it is more economical and feasible to contract with NMY&FS to provide Program Therapists for counseling, services, and support to the Probation Department Juvenile Detention Facility in Placerville. The Probation Department does not currently have staff members that are trained or qulified to provide these types of services. In Fiscal Year 2015/2016 Health and Human Services - Mental Health Division notified the Probation Department that they would be eliminating all services including providing for the mental health needs of minors in the Probation Juvenile Detention facilities. Pursuant to Title 15, California Code of Regulations, Standards for Juvenile Facilities, the Probation department is required to provide for the mental health needs of minors (wards) housed for any period of time at a Juvenile Detention Facility.
NMY&FS has provided services for the Probation Department since 2011 and proposed rates continue to be within or below rates charged by similar service providers within the County. Based on the ongoing need to provide service to this population of youth, it is necessary to continue to provide the number of service hours and types of services that NMY&FS provides. After a review of the agreement, the past performance of NMY&FS and the mission of the Probation Department, the Department has determined it is more economical and feasible to contract out for these services. Agreement 3249 with NMY&FS is for a three year term and a maximum contractual obligation of $287,400.00. NMY&FS is able to competitively provide the services to meet the mental health needs of minors (wards). Prior to the end of this agreement staff will review and reassess the best method to deliver these services to minor (wards) housed at the Juvenile Detention Facility in Placerville.

FINANCIAL IMPACT
No fiscal impact or change to Net County Cost as these services were anticipated and included in the Probation Department Fiscal Year 2018-19 proposed budget.

2. Board Clerk’s Office to return one (1) original of Agreement 3249 to Probation for distribution to vendor.
