Fiscal Impact/Change to Net County Cost:

The cost of this Contract Change Order # 06 Supplemental # 01 is $57,929.11, which will be funded by the Road Fund.  There is no cost to the County General Fund.

 

Background:

The Board awarded the Project construction contract to White Rock Construction, Inc. in the amount of $2,381,824.70 on January 30, 2007.  The Department has issued Contract Change Orders # 01-06 for a total amount of $44,813.54 and now needs to issue Contract Change Order # 06 Supplemental # 01 for $57,929.11, which exceeds the Department’s Change Order authority.

 

Reason for Recommendation:

The construction of the Apalachee Phase 3A Erosion Control Project (Project) is underway.  The Transportation Department (Department) has determined that the Contractor will have to do pavement restoration for the Project due to the age of the pavement, which has deteriorated over time.  The estimated costs for the new paving and the preparation work include utility adjustments, raising to grade storm drain manholes, sewer manholes and valves, and all preparation work required beyond the removal and disposal of the existing pavement.   

 

Public Contract Code Section 20142 allows a Board of Supervisors to authorize the County Engineer or other County officer to order changes in the work of a public contract.  This ability to delegate is capped at $150,000.  The Board of Supervisors, by Resolution # 106-93, has utilized this provision and delegated to the Directors of Transportation, Environmental Management and General Services, and the Chief Administrative Officer, change order authority not to exceed $50,000.  Delegation to the Director to execute this supplement is under the $150,000 limit prescribed by Section 20142 of the Public Contract Code.

 

The Project Contract has been prepared in conformance with County and Caltrans bid item payment procedures.  In doing so, certain items of work, necessary to complete the Project and which require a variable work effort to complete, are identified in the Contract documents as supplemental items of work to be performed and paid for on a time and material basis, using standard Caltrans force account billing procedures.  The work is authorized by issuance of a change order, which also encumbers the funds anticipated to be needed for each of the planned supplemental items and is billed against as the work progresses.  The amount of this Contract Change Order # 06 Supplemental # 01 is based on an evaluation by the Department's staff of the Project components, area, and time frame.

 

Action to be taken following Board approval:

The Director of Transportation will execute CCO # 06 Supplemental # 01 with the Contractor.
