Human Resources Department recommending the Board approve and authorize the Chair to sign Resolution 178-2022:
1) Adopt a new salary scale for the Assistant Chief Investigator (District Attorney) classification to comply with Article 4, Section 1 B. of the Memorandum of Understanding (MOU) between the County and the El Dorado County Law Enforcement Management Association, which provides the wage scale for the Assistant Chief Investigator (District Attorney) classification will match the wage scale for the Sheriff’s Lieutenant classification, and
2) Authorize the compensation of employee(s) in the Assistant Chief Investigator (District Attorney) classification for back pay resulting from the delay in implementation of the required salary increase.

DISCUSSION / BACKGROUND
On August 16, 2022, the County of El Dorado (County) adopted Resolution 122-2022, adopting the Memorandum of Understanding (MOU) between the County and the El Dorado County Law Enforcement Management Association. Article 4, Section 1 B. of the MOU provides that the wage scale for the Assistant Chief Investigator (District Attorney) classification will match the wage scale for the Sheriff’s Lieutenant classification, however, the Assistant Chief Investigator (District Attorney) did not receive the appropriate salary increase at that time.
As the base salary for the Assistant Chief Investigator (District Attorney) classification during the pay periods including August 27, 2022, through December 17, 2022, did not comply with the provisions of the MOU, Human Resources is recommending the Board:
1) Retroactively amend the salary schedule;
2) Authorize and direct the Payroll Division of the Auditor-Controller's Office to implement the Assistant Chief Investigator (District Attorney) salary increases retroactive to the pay period including August 27, 2022 and compensate employee(s) in the Assistant Chief Investigator (District Attorney) classification for back pay resulting from the delay in implementation of the required salary increase.
ALTERNATIVES
The salary increase is necessary to comply with the terms of the MOU between the County and the Union, adopted by the Board on August 16, 2022.
PRIOR BOARD ACTION
The Board adopted the MOU between the County and Union on August 16, 2022 (Legistar #22-1204, Resolution 122-2022).

FINANCIAL IMPACT
The retroactive increase will cost approximately $4,900 in the current the fiscal year. It is anticipated that the increased costs can be covered by Salaries and Benefits savings in the District Attorney’s Office from vacancies.
