DISCUSSION / BACKGROUND

County of El Dorado (County) and the El Dorado County Managers’ Association (Association) representing employees in the Management (MA) bargaining unit (Collectively, the Parties), have an executed Memorandum of Understanding (MOU) for the period through December 31, 2026.

 

A new Personal Leave benefit of up to 16 hours of leave time per year for a full-time employee was adopted in this MOU. As written, employees existing in the MA unit in April 2025 when the MOU was adopted would not receive this benefit until pay period 01-2026 (the pay period beginning December 13, 2025), while subsequent new hires have received a pro-rated benefit on their appointment date in 2025. This was not the intent when the benefit was approved.

 

Human Resources Department recommends the Board adopt and authorize the Chair to sign the negotiated Letter of Agreement (LOA) which remedies this discrepancy by providing a one-time Personal Leave credit for eligible MA employees who did not receive Personal Leave in 2025. The LOA shall become of full force and effect the first full pay period following approval and adoption by the Board of Supervisors and shall terminate on December 12, 2025.

 

ALTERNATIVES

The County negotiated this MOU in good faith with the Association under authority and direction of the Board, thus there are no recommended alternatives.

FINANCIAL IMPACT

There is no new cost incurred by Personal Leave, which can only be observed with time off and is not eligible for cash in lieu. This benefit, if fully used by all eligible employees in this unit, has an estimated cost of lost productivity (salaries paid, but not worked) of $120,000 per year.   

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Human Resources will provide the Clerk with three original LOAs for the Chair to sign upon ratification by the Association; and

2) The Clerk will return two original LOAs to Misty Garcia in Human Resources once fully executed by the Chair and retain one fully executed agreement for the Board.
