DISCUSSION / BACKGROUND
On September 22, 2015, the Board approved the Department of Transportation (Transportation) to begin the right of way phase for the Green Valley Road at Indian Creek - Bridge Replacement and the Green Valley Road at Mound Springs Creek - Bridge Replacement (Projects). The Projects involve the replacement of two (2) bridges (approximately 1,000 feet apart at Indian Creek and Mound Springs Creek) and construction of a continuous two-way left turn lane down the center of Green Valley Road between Stagecoach Road and Mortara Circle. These safety improvement Projects encompass approximately ½ mile of Green Valley Road. The two-way left turn lane will provide a traffic safety improvement, based on the accident history of this area.
The Projects require construction improvements that will affect Greenstone Country Owners Association (Greenstone) Assessor’s Parcel Number 317-285-019 as part of the Indian Creek Bridge replacement. Transportation will cause construction work and landscape impacts to Greenstone’s entrance at Stagecoach Road. Through several discussions with Greenstone, Transportation has agreed to compensate $25,000 for these impacts to their property. This amount is fair and reasonable to address these impacts resulting in the Memorandum of Agreement (MOA). The MOA illustrates the construction work and landscape impacts, including the terms and notices between Greenstone and Transportation. Transportation is requesting the Board authorize the Director of Transportation (Director) to sign the MOA and process the payment to Greenstone.
ALTERNATIVES
The Board could choose not to authorize the Director to sign the MOA and provide direction on compensation for construction work and landscape impacts through an alternate agreement.
PRIOR BOARD ACTION
1) On September 22, 2015 (Legistar file 15-1000), the Board approved the commencement of the acquisition process for the Project.
2) On January 9, 2024 (Legistar file 24-0043), the Board met in Closed Session.

FINANCIAL IMPACT
There is no fiscal impact or change to net County cost associated with this item. Funding for the project is included in Transportation’s 2024 Capital Improvement Program, which was approved by the Board on June 18, 2024 (Legistar file 24-0838).
