Title

Surveyor's Office recommending the Board adopt and authorize the Chair to sign Resolution 059-2021 for Abandonment of Easement 21-0001, to abandon a portion of public utility easements on Lot  136 and 137 of Cameron Park Unit No. 3, recorded in Book C of Subdivisions at Page 38, identified as Assessor's Parcel Numbers 109-161-002 and 109-161-003.

DISCUSSION / BACKGROUND

A request has been submitted by Steven S. Jones and Karen Jones, Trustees of the S & K Jones Trust dated February 7, 2005, owners of Lot 136 and Thomas G. Yancey, Trustee of the Yancey Family Trust dated July 16, 2013, owners of Lot 137, owners of Assessor's Parcel Numbers 109-161-002 and 109-161-003, requesting that the County of El Dorado, Board of Supervisors, vacate portions of public utility easements located on said properties. Subject easements are more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution. Said properties are within the community of Cameron Park, Supervisorial District 2. 

 

The public utility easements, as shown on Lot 136 and Lot 137 of Cameron Park Unit No. 3, recorded in Book C of Subdivisions at Page 38, were offered to the County of El Dorado by Robert L. Cameron, Ruth D. Cameron, and Michael J. Daugherty, on December 8, 1959.  The easements were acknowledged and accepted by the County of El Dorado on December 28, 1959, and the Subdivision Map was recorded on December 28, 1959.

 

ALTERNATIVES
An alternative would be to not adopt a Resolution of Vacation for Abandonment of Easement 21-0001. By utilizing this alternative, the owners of Assessor's Parcels 109-161-002 and 109-161-003 would be unable to pursue any development that would impact the subject easements.

 

PRIOR BOARD ACTION

OTHER DEPARTMENT / AGENCY INVOLVEMENT

AT&T, Comcast, El Dorado Irrigation District and Pacific Gas & Electric have not used said portions of subject easements for the purpose for which they were dedicated and find no present or future need exists for said portions of subject easements and do not object to their vacation, and to that end, have all issued letters to that effect.

 

CAO RECOMMENDATION / COMMENTS

Approve as recommended.

 

FINANCIAL IMPACT

The Surveyor’s Office collects a fee for processing the Abandonment of Easement on a time and materials basis.  There is no fiscal impact as a result of the approval of this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the one (1) Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution for further processing to the Surveyor's Office, Attn: Jane McClusky.
