HEARING - Environmental Management Department recommending the Board consider the following regarding the solid waste collection rates for South Tahoe Refuse Co., Inc., Areas A and B:
1) Based on the analysis completed by Crowe LLP, find that a 5.10% increase to Franchise Area A, along with a previously approved SB 1383 adjustment of 5.08% which is fixed from the 2025 rates; and a 5.10% increase to Franchise Area B existing rates be in accordance with the Interim Year rate setting process as outlined in the Solid Waste Rate Setting Policies and Procedures Manual; and
2) Adopt and authorize the Chair to sign Resolution 177-2025 authorizing an increase to the solid waste collection rates for South Tahoe Refuse Co., Inc., Franchise Areas A by 5.10%, along with the fixed SB 1383 adjustment of 5.08% based on the approved 2025 rates; and 5.10% for Area B for the 2025 Interim year to be effective January 1, 2026.

DISCUSSION / BACKGROUND
On May 1, 2012 (Legistar file 12-0494), the Board adopted Resolution 043-2012, authorizing a new Solid Waste Services Agreement (Franchise Agreement) with South Tahoe Refuse. On December 2, 2014 (Legistar file 12-0494), the Board adopted Resolution 227-2014 approving the First Amendment to the Franchise Agreement, consolidating the American River Disposal Franchise (now known as Franchise Area B) into the South Tahoe Refuse Franchise. On December 12, 2023 (Legistar file 23-1953), the Board approved the Second Amendment to the Franchise Agreement to incorporate SB 1383 requirements and is effective until December 31, 2043, with an option to extend for an additional five-year period.
The Franchise Agreement incorporated the Solid Waste Rate Setting Policies and Procedures Manual (Rate Manual). The Rate Manual was developed with the intent of establishing a consistent process and application for all Member Agencies of the South Lake Tahoe Basin Waste Management Authority, which is a Joint Powers Authority (JPA), to use in their respective solid waste franchise agreements.
The Member Agencies are the County of El Dorado, the City of South Lake Tahoe, and Douglas County, Nevada. The JPA is responsible for overseeing regional cooperation regarding solid waste and coordinating solid waste program planning and reporting to the Member Agencies. South Tahoe Refuse is the franchised hauler for all the Member Agencies.
The Rate Manual provides specific requirements for the setting of collection rates during “Base” years (every third year of the Franchise Agreement) and “Interim” years (years falling between Base years.) Base year rate adjustments require an in-depth financial analysis to determine if the rates require an adjustment, the amount of the adjustment, and whether or not an increase or decrease to rates is warranted. Interim year rate adjustments are calculated based on 85% of the Garbage and Trash Collection Consumer Price Index for the previous 12 months (June to June) and compensation for any increase in landfill disposal costs. The franchise hauler is not obligated to request an increase in interim years.
An independent solid waste consultant is utilized to review the rate application and to make the determination of a rate increase. The final rate analysis report is presented to the JPA for Board recommendation, and if the JPA does not recommend the report and rates, the JPA Board must specifically identify deficiencies. Once approved by the JPA, the final rate report is presented to the Board. The Board does not have the discretion to change the rate, only to approve or disapprove the rate request. If the Board does not approve the proposed rate increase, it must identify a deficiency, and the report is returned to the JPA for revision and returned to the Board for approval.

On July 11, 2025, South Tahoe Refuse Co., Inc. (South Tahoe Refuse) submitted an Interim Year Rate Application (Application) (Attachment C) to the JPA for the interim rate year 2026 for Areas A and B.
On July 25, 2025, the JPA met and authorized staff to engage an independent solid waste consultant, Crowe LLP, to perform the Interim Year rate analysis services for South Tahoe Refuse Co., Inc. (South Tahoe Refuse).
Crowe LLP completed its review and provided the recommended final Interim Year 2026 rate increase analysis (Attachment C) to the Member Agencies. Based upon its review and analysis, Crowe LLP recommended the approval of rate increases of 5.10% for South Tahoe Refuse’s Franchise Areas A and B in the unincorporated portion of the County for the Interim Year 2026.
Additionally, in 2023, the JPA also approved an additional increase of 10.16% for the mandatory organic recycling program implementation under Senate Bill (SB) 1383 to be split evenly over two years, 2025 and 2026, for Area A only. STR is required by SB 1383 to provide containers that follow the state-mandated color coding to collect organics (yard waste), recyclables, and trash. The service area is under a high-elevation waiver for food waste only.
The JPA met on October 03, 2025, to review Crowe LLP’s recommendation for rate increases in all Member Agency jurisdictions and approved the recommendation.
Procedurally, Proposition 218 requires that notices of a proposed rate increase be mailed to all property owners in the affected area, and that a public hearing be held not less than 45 days after the mailing. On October 22, 2025, 6,257 notices of the proposed rate increase were mailed to all property owners and refuse customers in the South Tahoe Refuse Area A (Attachment D). The notices informed customers of the proposed increases and of their opportunity to submit a written protest. The protest period will close at the public hearing. Absent a majority protest (i.e., 50% + 1, or 3,130 protests), the Board may approve the final adoption of the proposed rates at this hearing. The rate increases would become effective on January 1, 2026.
In accordance with County Ordinance 8.42.170, notice of the time, date, place, and purpose of the public hearing to adopt the proposed collection rate adjustments has been duly noticed to affected ratepayers. The County’s public notice is scheduled for publication in the Mountain Democrat on November 29, 2025, and December 6, 2025 (Attachment E). In addition, South Tahoe Refuse notified every affected customer by postcard prior to the public hearing (Attachment F).
ALTERNATIVES
If a majority of property owners/tenant rate payers protest the rate changes (3,130 written protest), the Board of Supervisors is provided copies of the ratepayer protests for their review and may choose to either request that staff go back and make changes to be reintroduced through another Proposition 218 process before consideration of an adoption is entertained or withhold adoption of the proposed rate changes altogether.
Without a majority protest, the Board of Supervisors has the legal authority to adopt the proposed rate changes as provided for by Proposition 218, the Franchise Agreement, and the Rate Setting Manual. Denial of the requested 2026 Interim Year rate increase would not be consistent with the terms of the Board-approved Franchise Agreement and Rate Manual incorporated therein. Section 22 of the Franchise Agreement provides that rates are "established and adjusted" in accordance with the Rate Manual. The Manual provides that a Franchisee "shall be entitled to adjust its rates" during an interim year based upon a formula that includes the CPI. If the Board does not approve an interim year Application, deficiencies must be identified in the Application for determining the rates, which would require the JPA to address the deficiencies and return to the Board with a resolution for Board approval/adoption. Staff, along with the JPA, has reviewed the Application and found no deficiencies in the Application, supporting data, or the required notice.

FINANCIAL IMPACT
The increase in the rates proposed by South Tahoe Refuse is directly related to the cost to provide this service to customers. The County’s Franchise Fee will remain at 5%. However, as rates are incrementally increased, the County will see a slight increase in Franchise Fee revenue.
