Fiscal Impact/Change to Net County Cost:
There is no fiscal impact to the County.  The amount of the consultant agreement is $60,795.00 and will be reimbursed by the applicant for ConocoPhillips Company in a separate reimbursement agreement.
 
Background:
The proposed project is a 76 Gas Station and Circle K Mini-Mart located on the south side of Mother Lode Drive at the intersection with South Shingle Road in the Shingle Springs area, identified by Assessor's Parcel Number 090-432-42, consisting of 0.65 acres.  The proposed project is a 2,976 square foot Circle K Mini-Mart and a 76 Gas Station with six fueling stations under a proposed 4,000 square foot canopy.  
 
This project was approved by the Planning Commission on June 14, 2001, with adoption of a Mitigated Negative Declaration (MND) addressing traffic concerns.  The decision was appealed to the Board of Supervisors who referred the matter back to staff for further evaluation of issues raised at hearing.  Staff returned to the Board with a revised MND on June 11, 2002, at which time the Board determined an Environmental Impact Report (EIR) was required.  The consultant selection process culminated in Pacific Municipal Consultants (PMC) being awarded the contract.  A Notice of Preparation was circulated before contract negotiations stalled progress on the project and it was placed on hold.  A new contract was subsequently executed in February 2005 to expire December 31, 2005 with a one year time extension. A Notice of Preparation was reissued in April 2005.  A Draft EIR was prepared and circulated with the public comment period ending January 27, 2006.
 
Based on public comments, on May 4, 2006 it was determined further analysis was required regarding access and on-site turning movements prior to preparation of the Final EIR.  Timelines were suspended during subsequent discussions regarding the revised scope of work, and obtaining the necessary information for thorough analysis.  On November 16, 2006, Planning Services received the contract modification request regarding the revised scope of work in preparation for the Final EIR. Authorization to continue with PMC was received from the applicant in their acceptance of the revised scope of work on January 3, 2007.
 
The contract request packet was submitted to Purchasing in accordance with the Purchasing Ordinance.  In accordance with the Purchasing Ordinance Section 7.4 Delegation of Authority to Process Contracts, the Purchasing Agent and the CAO have concurred that the Development Services Department has the authority to process contracts for Environmental Impact Reports that include funding and/or reimbursement agreements.  All contracts, funding and/or reimbursement agreements will be reviewed by the Deputy Director - Administration prior to submittal to County Counsel.
 
Action to be taken following Board approval:
The Board Clerk's office will forward the executed Agreements to the Development Services Department for distribution.
