Background:
On October 31, 2006 the Board approved Agreement for Services # AGMT 06-1019 with the California Highway Patrol (CHP) for a two-year term and a not-to-exceed compensation amount of $290,000 for traffic control and traffic enforcement services, based on proper advance notification, during construction phases of various Capital Improvement Program (CIP) construction projects within and in the vicinity of El Dorado County.
 
Reason for Recommendation:
The Transportation Department (Department) is proposing to amend its existing Agreement with the CHP to extend the expiration date of the Agreement to June 30, 2009; to include the CHP's most current rates; and, to allow for future rate increases by written notification.  There is no change in the not-to-exceed compensation amount of the Agreement.
 
The Department is requesting approval of the subject Amendment while the Department is in the process of negotiating a new Agreement for traffic control and traffic enforcement services with the CHP, in the amount of $500,000, with a term starting July 1, 2009 and continuing through June 30, 2012.  Since negotiations between the Department and the CHP can take up to several months, the Amendment is necessary to prevent a break in CHP services.  The major projects for which the Department anticipates requesting services under the proposed Amendment and the new Agreement include the upcoming U.S. 50 HOV Lanes, Phase 1 - El Dorado Hills to Bass Lake Grade Project and the U.S. 50/Missouri Flat Road Interchange Improvements - Phase1B Project.  Both projects are multi-year projects and are scheduled to begin before the new Agreement could be approved.
 
To ensure safety on CIP construction projects, traffic control and traffic enforcement services are sometimes necessary within and near the limits of the construction area.  These services are required during specified stages of work, including detours and blasting operations, to control and allow for the safe movement of public traffic within the construction area.  The individual budgets for each of the CIP projects include funds for these services.
 
Although the El Dorado County Sheriff's Department (Sheriff's Department) has classifications that could perform these types of services, the construction activity often takes place within the State of California's right-of-way, outside of the Sheriff's Department jurisdiction, making traffic control in those areas the responsibility of the CHP.  If a project does occur in a location that is within the jurisdiction of the Sheriff's Department, nothing in the Agreement precludes the use of the County's own resources, should they be available.
 
Pursuant to the El Dorado County Charter, Article II, Section 210 b (6), the County may enter into any contract or agreement in cases where the agreement is with or among any other governmental entities or agencies.  The services to be performed by the CHP require skills that are expressly identified in County job classifications, but because of possible jurisdictional issues, County employees would not be able to perform the requisite services at all of the locations that may require traffic control services.  The services to be provided under this Agreement are temporary and sporadic in nature.  
 
In accordance with the Feasibility Analysis, the Department is not required to notify an employee's association regarding this Agreement.
 
Action to be taken following Board approval:
1.  The Board Clerk will obtain the Chairman's signature on the two originals of the Amendment and return them to the Department.
2.  Upon receipt of the two originals of the Amendment, the Department will forward both originals to the CHP for signature.
3.  Upon receipt of the fully-executed original Amendment from the CHP, the Department will forward it to the Board Clerk and retain a copy for its files.
