Fiscal Impact/Change to Net County Cost: The total not to exceed amount of this agreement is $1,600,000 for the two year contract term.  There is no change to Net County Cost.
 
Services provided under this contract are mandated entitlements and the state is legally required to pay for them in accordance with established formulas.   Funding for the current fiscal year is secure.   Funding beyond this fiscal year may be subject to changes in how Medi-Cal services are reimbursed by the state.   However, the Governor's recently submitted proposed budget will likely have only minimal impacts on the Department's funding for these services.  
 
Background: The Mental Health Department has contracted with Sierra Child and Family Services, Inc. to provide specialty mental health services for children on an "as requested" basis for over five years.  These services include psychological testing, individual and group therapy, therapeutic behavioral services and crisis intervention.  The current contract was approved by the Board on June 26, 2007.
 
Reason for Recommendation:  The six month term of the original contract was established to allow the Department to continue receiving services from the vendor while conducting an analysis with the Public Health Department on the possibility of rate standardization for contracts that both departments have with this contractor.  The Department determined that the billing models for Mental Health and Public Health were sufficiently different so as to preclude a cross-departmental standard for billing rates.  As a result, the Procurement and Contracts Division has processed Amendment I to the subject agreement to extend the term and increase the not to exceed amount with no change to the rate structure.
 
In accordance with Board of Supervisors Policy C-17, Section 7.4.2, the Purchasing Agent concurs with the department's request to amend this agreement.  The amendment calls for an increase in compensation by $1,293.000.00 for a total not to exceed $1,600,000.00 and an extension of term set to expire June 30, 2009.  
 
The Purchasing Agent has coordinated the required review of the contractor's qualifications to perform the needed services.  The outside reviewer found that Sierra Child and Family Services, Inc. has demonstrated its ability to perform the work based on prior experience with the contractor, qualifications of the contractor, and the availability of the contractor to perform the services.  The amendment is retroactive due to the additional time required to conduct the required outside review.
 
The County Purchasing Agent has reviewed the department's request to contract with Sierra Child and Family Services, Inc. and concurs that the continued use of this contractor is appropriate in order to avoid an interruption of needed services provided to the clients of the Mental Health Department.
 
The Purchasing Agent has determined that it is appropriate to dispense with any competitive selection process for services performed by Sierra Child and Family Services, Inc. as the department contracts with multiple local area firms to provide similar services to its clients on an "as needed" basis.  The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5, and 7.10.
 
This agreement will allow for the continued provision of specialty mental health services for emotionally disturbed youth. The amended agreement covers the period July 1, 2007 through June 30, 2009.
 
Action to be taken following Board approval:Board Clerk's Office will forward the executed agreement to Mental Health for further processing.
